So, I do wanna echo the comments that other members of efficiency community you've said, by the way, I'm making these comments on behalf Northern California Guides and Sports
Association. I know that James Stone, the Executive Director was trying to get on as well, and I'm not sure if he'll be successful.
I think we want to start by thanking the commission and the department for
recognizing that leadership starts at the top and that
communication and clarity are key.
I think that we all recognize that, the community had a much better understanding,
after what happened last Thursday about the intentions of the commission and the department moving forward. And so again, want to commend the director,
Human to President, the staff and others who worked so hard communicate with us as representatives of the fishing community to help get the word out to others.
I think we want to acknowledge a couple of points. The first is that
creating
solutions for some counties is going to
inevitably caused problems for other counties. And by that, we are concerned about a pressure shift. We've seen this with the inland fishing on the Sacramento river and the tri.
We saw this with Ocean Salmon and it was one of the reasons why the Salmon advisory sub committee made a recommendation to the P to delay the season opener
when the ramps and other opportunities for access are being closed it divert that focus to other places
Rightly, or wrongly, I've heard people talking about stay at home orders and restrictions sustained within your own county. I think we need to recognize that there is going to be travel as both attempts to do outdoor recreation.
And that is just a reality that we need to live with and the fact is that that these actions are going to cause unintended pressures in other places. So to that, we have several questions.
We recognize
today that there are three counties that are requesting closures.
When staff comes back and provides comments later, we'd like to ask
what the process will be for other counties moving forward.
And the opportunity for the public to participate in those
conversations relative to those counting if they make those requests.
Second, we'd like to ask for
clarification on a process for resolving discrepancies
between any directive coming from the governor's office
and individual requests from specific counties
related to
stay at home
access to outdoor opportunities, I believe that as we move forward,
and the governor has started to talk yesterday about what the next steps for the state are,
that there will start to be discrepancies
between regions and the state. And I think it would be helpful for the director to provide some clarity on how we're going to resolve those discrepancies.
Finally, we put this in our letter and this is not the appropriate time in place to get into it entirely, but we do remain concerned about the delegation of authority from sufficient gain Commission outside of its body to other jurisdictions. In this case, the department. We recognize that the pandemic
is something that we've never experienced before. We recognize recognized that these are
unusual times. We also recognize that we could be back in a situation in the fall in the winter
when we're talking about doing something like this relative to hunting.
This could be a seasonal virus, this could be something that we go through.
I'd really appreciate some thought and some attention from the commission and the staff as to
how to deal with this the next time that comes around.
We encourage the commission to retain its authority vested in it by the constitution and the appointments provided by the governor in each of you,
to be the end all be all the determining factor of these decisions. Again, thank you for the time and the opportunity to speak today and,
really appreciate it.
I wanna make two comments. One is we're gonna limit each speaker to one minute, we'll be timing that and we'll we'll ask you to stop at one minute and cut you off if you keep going. And the total amount of time, unless any other pictures wanna raise their hand and suggest that we do a greater time. The total time is five five hours with the number of speakers in line. We won't get anywhere near that. But we are limiting the total time to five hours, which begins right now at, eleven fifty.

Okay. I'm I'm glad you got to go. I'm glad you got to go first congratulations congratulations congratulations and to thank so much your patience. And thank you guys for doing this meeting. You know, I can't thank you enough for letting us have our voices heard.
My concern is that although the meeting is mainly about the trout season, the outcome could have the potential to shutdown fishing everywhere, whether fresh water or salt water.
San Diego has already completely banned us from fishing. The closure can be viewed on the Port of San Diego website. We can't fish for food on any of the waterways.
In fact, my husband and I can't even take our boat that we live aboard out. To go to the ocean and fish.
San Diego County has closed the harbor and our access to the ocean. We're completely self contained to go out and catch your own food. It would be much safer than going to the supermarket and exposing ourselves to other people
and the poor cashier years,
but it's not really working out very well here.
Henry Kissing once said, whoever controls the food supply controls the people.
We're already hearing about shortages or disruptions in the Us food supply chain
particularly in the meat industry. Folks will meet the fish.
Our local and state officials must not prevent people from feeding themselves.
Please don't restrict our bill ability to fish.
We really don't want the government to to take care of us. Thank you so much.
K. Thank you. And thank you for your patience. I just wanna answer your question because you were so patient and in waiting for us. Yeah. Local ports are not under the fishing game nor the Department of edition Wildlife
jurisdiction.
In general, our goal here is to allow it as many people
fish as safely as possible and we wanna encourage local authority to do the same when it doesn't interfere with proper social distancing. And I wanna let the director bottom at alignment and what hear yourself. K. Yes.
For one
additional detail
as an example,
the ground fish sport efficiencies season and,
I did open April one,
certain parts of the state.
And
damage management
decisions are proceeding
or
polling openers,
and that's occurring at the federal
level
at a federal account.

The part of my concern here is other states open they're fifties early, and I see a pretty more from, like, previous color markers stated that with he ban it and some counties are stopping at in some counties that they're pretty people to the other counties. And so you're really not slowing or stopping the spread. He's gonna let's scan the spread.
People want it is essential if people see their families again, like the previous car the state... And they renegotiate it that, you know, people need to see their families. That is part of essential leaving.
You know, it is the domestic violence calls, the
increased depression calls and stuff on the outlines we're getting worse because people can't get out and enjoy themselves. Well, when you're out fishing, I I don't know anyone that really sits more than six foot
apartment fish fishing. I mean it's pretty hard to cast the pull or or, you know, hook somebody if they we stand a little closer than that. So this is this is something to me that is it is far fetched. Yeah. I understand it's only for a few counties. But at the same time I see it is probably gonna extend the other county. If we allow this to continue. And it's something that really shouldn't. You know, I'm sorry for those counties and they feel that they may have a problem controlling because they don't have enough staff for So,
but that's also up to the county to then you know, mandate or get that staff to do so. As I... Know, other cities and Counties are actually changing their staff that just got some people sitting home to put them in vehicles to to assist with it the other
enforcement or people don't to notify the public, you know, six foot distance and and help keep people at home. So please please not not limit these counties and and do not
prolong the fishing. Actually, it'd be great if we followed other states like Philadelphia Vermont so forth, where they actually increased or we're opened early for people to fishing and provide further damage. Thank you. Fred, Laura, this is James Stone. Can you hear me?

Thank you very much. I've been trying since the beginning,
a, presence Clark, commissioner, staff, as well as department staff. Thank you very much for the communication since the past mission meeting, we really appreciate
all of the dialogue to try to put out the correct back to the fishing community.
I think that, unfortunately, with social media and how fast that rumors can spread a lot of
misinformation was put out there. And so we wanna thank the department for putting out the fact sheet and for clarifying exactly the intentions of this emergency meeting.
We also wanna thank a commission for not just doing a right closing the entire state and painting it with a broad brush. We we appreciate you... You guys not go in that direction.
Recreational fishing as you know as bio from the outdoor recreational community, and a lot of people can still get outside while properly social distancing team and enjoy the outdoors through fishing.
We do respect the surgical
approach that the director and the certain county, the requesting and taking on a county by county basis
strictly due to board of supervisors or public health officials announcements
rather than just trying to do an alt right closure.
As you know as well, our fishing guide community was deemed none essential on March sixteenth by the governor's order, and the guiding community is hurting like many other businesses right now, and it's spiraling down a a tube that we don't know if we can ever recover from.
We appreciate any clarification on that in the future, and we also would make recommendations of the department to continue with fact sheet weekly if not, bi weekly, that could at least.
And now what waterways
are currently still open and and and and are not closed because the misinformation out there causes a lot of confusion and then causes rumors that you're gonna shut down the entire state. We appreciate everything you're doing and thank you very much for this time.

Marilyn and Jasper public interest coalition, we totally support authorizing director bon to make proposed critical decisions as needed to stay ahead of
potential problems,
instead of too late reactive
in order to protect not just locals, but all people.
That said, to avoid enforcement nightmare
and
increased risks to wildlife officers
if areas are closed,
the order must apply
equally to all,
no exceptions.
Any exemption for groups
organizations local or other reasons will compromise
both the order
as well as safety for all of us. We greatly appreciate the commissions taking this responsible action. Thank you.

Alright. Great. Thank you. We represent thirty seven Rural County Statewide and you've already heard from a whole bunch of our members today, so I won't
go on too long, but I just wanted to, back up and so court those three counties that have made this request. And also, I believe Sierra County has made a similar request as well. I have their letter and I can forward that to you if you don't have it on file.
What our
request in support of this is to be on the request of the local government as we've seen to the four county so far
to allow director bottom to work with these local governments. And if any other local governments have difficulties in the near future
write these counties. Some of these smaller counties. They just don't have the capacity
to deal with a lot of outside residents coming in for the upcoming fishing season,
and, you know, they don't have the... Neither the staff nor the financial ability to deal with this. And
we support their request and wanted to make sure that as we've spoke up on our behalf. So thank you for
undertaking this today. Thank you.

the fact that it should be county by County.
Being in the military. It's not as easy to pay for food. We have discounted food, but the same time in order to actually save food or money,
it is easier to go fish.

you're not right on top of others.
So
you can...
Or practice your social distancing thing while fishing and
fear fishing whatever kind of fishing you wanna do, you can maintain social distancing.
And still be able to effectively fish.

I live a hundred feet from the river,
logged this twenty miles stretch of river that opened up in April four.
And just to say, I yet to see there are been beside myself on there.
I do use it full food.

I think everything's been discussed about,
also a distancing in the counties that need to close. And,
my main thing is, I think people are coming, you know, the the travel.
Ban. I mean, you know, stay at home isn't being listed South like those is a good example.
The thing about it is you have thinking it out to the people. If I go to
Google and I do California camping campground,
and there four hundred pages about how the state campground grounds in the state to in the State park are lot in the state state state states.
Very, very few people know that the National Court campground are very few. If you wanna... You can't stop people from traveling. They're gonna do it. But many you can discourage people with all the campground. I think a massive media push
saying everything's closed.
The campground clothes, the boat ramp for clothes, the motel are closed. Everything is closed, please don't come. No one knows that the asshole force.
Campground are closed. You have to go to each individual site and ac. Click on the campground
at lake Davis that you wanna go to before you run into is closed.
Massive media, people
in the Bay area don't know that the not so before campground are closed.
The average person. So they come up for her with her trailer,
and their motor home, and then there's a old park on a dirt road somewhere.
You just have to get the word out. You know,
it's closed.
Anyway, I think you guys are doing a good job. And I think surgical

Hi. My name is Sean Nash, and I would just like to inform anybody trying to get into the queue,
just to let you know that you have your raise. Once you press pound two, it should come over the speaker and let you know that your end is raised.
I know some people around me were trying to get it and it wouldn't come up.
I would just like to start by saying good morning for the members of the board. And instead of sitting here and complaining and adding problems to the situation. Instead, I'd like to propose some solutions that would benefit both parties of the argument.
I'm proposing that all commercial recreational and saltwater vessels be allowed,
continue to fish as they provide the safest of distancing being isolated from the public. And to address all others such as peers lakes. And both private fisheries, both fresh freshwater and salt,
maybe we should put in place a minimum safety distance between anglers that could be pun punishable if broken. And require that all anglers wear protect protective face masks at all times.
As a prior trout hatch... Hatch worker myself. It would not only hurt the hatch, if fishing has been closed,
because hatch cannot continue to produce fish, if dish are not caught, bought and sold. It would leave a backlog of problems that would only hurt hatch and stock lakes in the long run.
Private hatch trees,
stock over thousands of lakes in the Northern and Southern California areas and are not effectively equipped.
Stalled sales for this long, and we'll have extraneous amounts of die and backlog that will affect private lakes for many years.

remote remote rural area of Swallow County, and I just wanted to comment. I think people are focusing too much on
the
The social distancing of actual fishing itself and not thinking about the travel aspects that go into this.
Our local market here is small, very tight. There is no social distancing possible, the gas stations,
have
small restrooms available,
everybody who drives up here,
from, more urban areas are stopping at each one of these locations.
And with the potential spreading
this virus. And so it's not just about social distancing on a river, which is easy to do, or, on the ocean on your boat. It's about social distancing when you are traveling and the exposure you're putting on these rural counties,

We cannot fit. We cannot go to the ocean and surface fish. We cannot get on a boat to fish the peers are closed, the jet that closed, the local lakes are closed. The strings are closed. If this is not fair that the D is considering closing fishing for all Californian
because a couple small cities decided we don't want visitors.
And like we heard their their politicians speak earlier in this meeting. They don't want
visitors to come and fish. It it should be left open to the locals they... But they bought all means don't step on their rights. Just stop on the right of those flat lenders down there that that are disease. And wanna come up here to the mountains. This this is...
I absolutely in insane. The state of California has told me, I cannot I cannot provide for my family, you can only go to state approved store and by state approved goods when they're available. I don't know about the rescue. I've been to the store three times in the last month. There was no meat. There was no chicken I was four your. One minute is up. Love to let you wrap up if your like.

opening date of Salmon was moved back just thirty days.

About all of the
upcoming openers
relative to Salmon recreational in the ocean
and confirming those dates.
So some of the frustration we made here in this call
may more likely be about
access points that are really subject to local jurisdiction,
not the commission nor the department, certainly not in the proposal

County governments are already restricting or barring access to phishing, phishing sites and being able to get out there and do that. This request moves the burden of responsibility from local lack of officials. To an una elective state agency. So I would suggest that you leave local governments to enforce their local
regulations.
They're already in contact with the constituencies.
I think it's gonna damage the trust between anglers and hunters
and the department of efficient Wildlife.

I was looking at the draft emergency statement, and there is a lot of talk about surgical
effort
on this. Proposal. However, looking at the proposed Greg Report language subs section b, it says the department shall temporarily close or restrict,
and then what the things that they will consider.
The surgical
criteria
that you actually need to have in that provision is found in the draft
informative digest.
Specifically the areas or regions where large gatherings of fishers have been historically known to occur areas where new gatherings are occurring
water or areas that experience a significant number of non res fishers or areas of regions that have limited
emergency and health services availability.
Votes, that's the criteria
that you should be making the decision on the proposed regulation does not reflect it. Therefore, the proposed regulation is extraordinarily broad, and that's why a lot of people are
opposed to this proposal.
And so the other thing to that I wanna point out is that you could also suspend non res licenses if you wish to do that something like that instead of,
doing a broad
blanket brush.
The other thing is if you do it by county,
then what if the waters river streams goes or or lake process into other jurisdictions, you have and it's only one area that you wanted do. Three minute is up wrap up. Okay.
Yeah. The the last thing is is that I wanna... The
the reopening of the, waters under subs section c,
any order that is given under subs section b would automatically
be ineffective on June one, even if the waters are not been reopened under subs section c, and that would
that needs to be clear under subs c.

Hello. My name is Will Withers from Huntington Beach California, and I just want to make a couple points.
First off, I understand that this can daniel's pandemic there's obviously a lot of new things going on and there's another clear
clear direction I was where to go.
But a couple points, I wanna make regards to this. Is that first, I wanna make sure.
That there is clear and defined measure
of what we'll define opening up,
the efficiency season
up there as it's already kind of been...
You know, it seems like you... The decision has already been made in some aspects
so Gap governor news will likely not just open the flood gate and say, hey, everything's open now. There's likely gonna be a phased approach,
and he will specifically not call out t scenes in the Eastern sincere. So I'd like to see some verbiage defining what it is that were linked to,
that would actually say that the season is now open or able to be open.
The second one point I wanna make is around establishing precedent.
As most the people here have
made to people in San Diego County. Know. I know that the Fishing game commission has not typically c closed Fishing in
San Diego, but our access to
the ability to fish has been severely limited.
So the cities and insurance sierra should be responsible for controlling access similar to other,
cities around the state,
they can control that access by closing hotels,
closing long ramps, closing things like that. That's how they can mitigate the influx of people coming up there. But they're the Daniel commission taking this sir. Ask you to wrap up your minute is after Go ahead and finish it up.
Vision game is going to be overs stepping their boundaries
by closing specific

I'd like to urge the commission to allow to the maximum extent possible,
access to recreational fishing and shellfish fishing.
Recreational sport fishing is a crucial means of providing healthy food for one oneself,
allowing the ability to provide food for oneself is more important than ever, as many of us are now without a job is standing on the bank of the ocean or a river cannot be more of a risk to our community than standing in line at a food bank,
Additionally, social distancing could be practiced effectively while an.
The budget for the department of Efficient game will be severely negatively impacted if thousands of people do not purchase a license in the coming months.
Article section article one section twenty five of the California
constitution, guarantee citizens the right, the access of waterways.
Counties have no authority under California
constitution to limit that access.
Furthermore, I'd like to urge our elected and non elected officials to continue to uphold and defend the Us constitution as well as the California

some clarification in the wording. A lot of the even the stuff coming out of your office here, does not specify that this is to be restricted to certain counties, and it really does sound like it's a statewide issue.
I think that, I would also like to support the people who say, Yes. Standing on the bank of a river is about as socially isolated as you can get. Even the people you go with, you're not likely to be standing within six feet from. And the idea that the line at the grocery store is somehow safer than a boat ramp to me is somewhat ridiculous.
I think that this is...
Doesn't really have a whole lot of precedent in anything we've ever done before. And
I feel like this is a matter best left to the individual counties.
And that some level of just getting... As I was also said before, of getting the word out there to people that don't travel to these places,
they don't have the facilities to support your travel right now, getting that word out there is the most important part
and I don't feel that additional regulations are required for this.

I'm trouble that were presumed guilty of negligence until proven innocence.
Fishermen do not
do do not visit these counties unprepared or without knowledge of remote businesses will not be open. Let alone rely on those businesses to supply them with their needs in order to.
We these businesses at higher elevation down to support the fishing and hunting communities. These businesses have now flows and there's not an ability from for outsiders to transmit the virus to operators these businesses and other residents due to their closure.
Furthermore, if these counties wanna truly isolate themselves from other counties in fear that they cannot prevent the spread of Covid, they must take more extreme measures than not letting visitors on their highway to fish. So these counties are willing to stop all residents from leaving their home. Stop all deliveries from neighboring counties, and completely isolate themselves within in the state of California, the these counties should remain open to the crowd season. Commerce is a two way street. You do not get benefit from neighboring counties,
delivery of supplies is goods, And then on the other hand, restrict those county from traveling and recreating safely and responsibly within your borders. Thank you guys for your time and consideration and listening to my voice.

Okay. I do support the... County being able to decide whether they are open or closed. But on that note, I would like fishing games to also step in and let counties know that if they going to say that they are open that their ramps need to be open,
and their base options need to be open. There are several bait shops right now because they don't sell any sort of drinks or toilet paper that are being forced to close,
and they're gonna be closed for several months versus other stores that are open right now. So I would just like,
if we are going to give counties the option, if counties are going to be open, then they need to be open to
The stores also supply these products that are essential for fishing.

the Los Pad National Forest.
And we are concerned about the financial impacts on the hatch trees. Most of the
traditionally we do is planted trial that California pit fish and wildlife plant
or recreational fishers.
We're also concerned about the impact to four hundred L,
which is federal land that had joined us. We have a lot of friends and neighbors that fish there,
and that would be impacted
on their recreational fishing.
So we
do support the counties that are requesting. This is the other speakers have stated,

but we would like to see the surgical

I'm saying that because their fishing was taken away, and it was un unwanted because it was the

This issue should really not be in front of fishing game. The authorities, the the agency that addressed this issue are of state
and the county themselves, and they're pushing this off to an agency that really shouldn't have this authority.
It's travel.
It's ultimately travel. And under the the shelter in place, we're not even supposed to leave the area of our homes
for our counties.
So there's means to enforce this, and it's rough, but there are means.
California state is in
control of the highway patrol. And if these counties need help to keep people from coming in. That's what they should do. There are other types of recreation that aren't
being told, they can't keep things. And in one of the letters, they're saying the reason they want this because they're noticing people move in to their counties for other types of recreation. I just don't think there's this fair

The diversity of the state to me is is really a challenge. Right? When we look at the the of Covid, it's it's heavily located in the Bay area, it's heavily located in the sacramento area, and it's heavily located.
And other specific parts of the state, La, San Diego and and now unfortunately, run of county, which is really what's driving this.
Adopting a a piece of or an emergency action that may be able to be applied unilaterally,
the same way across the entire state at the that the limit counties is a little bit dangerous to me county And
it makes me feel as though we're we're just setting ourselves up for a slippery free slope where
you know, various counties see that
this that they can... That they can lock people out of fishing or recreating successfully.
And that translates downstream out counties. So I really challenge
the commission
to to think carefully about this decision and and about maybe a different way to structure the language that would allow
the counties that really need the help to get what they need,
but to recognize that the diversity of the state both in terms of population,
and the threat of Covid

The charge efficient wildlife is to protect efficient wildlife. The public health agencies protect public health through their orders.
Current public health orders provide adequate authority to enforce the need to reduce the spread of Covid nineteen.
These public health regulations automatically adjust for public health orders and the governor
Christian Wildlife agents can support the public health needs with current practices of monitoring angle behavior
and checking
addresses associated with licenses.
Our request is enforcement.
For all of this,
and limiting access to local residents based on the local public health orders for what it's best to reduce the risk to the communities

more regulations will just further stress the in the, law enforcement resources

provide for the season when the conditions under which the different species of fish may be taken.

Is my opinion that efficiency related changes being made because it may be envisioned by counties might request closures

Okay. So the very first thing I wanna say, this is Chuck on again is a deep.
Thank you full of appreciation for everyone.
Who's dialed in today. I think we might have hit close to four hundred participants.
This proves it's possible
to
do our public business.
Under current circumstances
in a way that's respectful of each other,
gives us a chance to share and understand where we're all coming from independently,
and
thank you to each of the comment or elected official tribal,
fishing leadership and individual citizens.
Whether you fall in the agree, disagree,
don't really know mixed feelings,
each person
really showed
what it's like for us is Californian have a conversation on something we all care about. So a huge bank.
In no particular order
trying to think about some of the questions that I heard.
Let me reiterate just out in the ocean.
Yes, there appears to be a patchwork of approaches that is happening in coastal counties
but things around peers, marina, harbors
are not the commission nor the department
jurisdiction.
In fact, in the ocean, the department has worked really hard
with the recreational fishing industry
and commercial and recreational fishermen and women
to get ground opened as an example
to delay slightly the original part of the salmon season, but moves the thirty days to the back of the season.
And in a matter of days, we think we're gonna have additional
clarity for ocean, fishermen and women
about
keeping your recreational opportunity
particularly for salmon in the ocean?
Second kind of theme that emerged,
how do we reopen?
Well,
I believe as director, we would reopen
like potentially if we were granted this disability, we would delay.
We would do it as promptly
as possible,
engaged with the local governments at the level of health
law enforcement
elected
in tribal government,
and we would try to move everything
that might have been delayed
to reopen
promptly.
Also, I think,
if you look at the actual proposed draft regulatory language,
anything
that might be delayed
under section eight point o two b
would necessarily be opened
by the time you get to section g
and all of the
regulation expiring
on May thirty first,
So either,
I think you would see reopening because of the expiration
or the department and consultation with the president local government and tribes
would reopen before then,
or to avoid confusion, the department could affirm
not only is the emergency
regulation expiring,
all of these waters are now open.
As to another question,
how will we know
I would encourage folks to remember the actual proposed regulatory language. I think it's Section e
directs the department to maintain a list of affected waters and restrictions
we would be required to update that list daily by seven Pm.
And also, there's a number to call for information. I'll tell everyone that number right now. It's nine one six
four four five.
Seven six zero zero, and those two fish official lot,
and it is true that some of your elected and non elected officials do fish on one of them.
Know that those mechanisms already exist
to figure out what is open and not open.
So that's something that came up.
As to
input
well placed by supervisors from Del,
Trinity and Humble,
each of whom I know.
I hear you.
I understand your suggestion of the word consultation.
I will give you my personal commitment. The way I would approach this as director
is to be in
consultation.
With
county
as they may come to the department and the commission.
I would be interested in consultation with the public health officer,
the sheriff
and the Board of supervisors.
Before the department
and I as director would form any opinion on what to do.
Same personal commitment as director to each tribal government
that may elect to engage with the department on this.
The door would be open. Our travel advisor Nathan Bog and I would want direct
communication with the right part of a tribal government. If they were still inclined to
come to us because of this emergency
regulation.
I understand Bart Hall suggestion to consider adding days at the end of the season,
if we delayed at the beginning.
I think that's a legitimate variable, the department and the commission and,
our stakeholders would want to engage on.
Because you are right, the department and the commission are committed to increasing
not decreasing opportunity.
And but for this pandemic, we wouldn't be talking about this situation.
To remind folks,
couple poke folks asked about how can we trust
unity and what if there are discrepancies
in ways, local government wants to treat it and
how the state government may approach it through the commission in the department?
This emergency
regulation self expires in forty six days.
I would also, if given this ability as director,
the required
to come to the commission's meeting
in, like, a matter of three weeks early May mid May
and do a full transparent
reporting
of what has or has not happened
relative to this emergency
regulation.
Why not just say three counties?
Look, when we started to realize this could be an issue, we were still also trying to get our arms around who might be interest?
The regulation reflects the fact that the criteria
prohibits the department from taking steps
without
consultation,
my words,
consultation, my commitment director,
consultation with local government,
and in consultation with the president.
I don't think they've granted disability, it's why it's for the department for runoff and use
without
constant
regular
communication with likely affected stakeholders.
We realize the importance of recreational efficiency.
Here's an easy one, no.
We're not exercising marshall law,
just running through the questions I've been asked.
I'm aware of article one, section twenty five. I've read it.
I've memorized it.
Well, I don't practice anymore. I am a
an attorney by background.
I will remind folks that the last provision of that article
says
except for
the ability to restrict seasons in use.
That's been tested in court regularly.
I think what the commission would be doing here if it were to approve the emergency
regulation.
Is restricting use around the season.
The department could have come to the commission with a proposal like the state of Washington.
We did.
We tried to find something careful deliberate and thoughtful.
We've been given this
delegation only once before during the drought.
We've only used it once.
In the next forty six days, I realized we need to prove
It's worth trusting us, and that would be my focus as director.
So with that, let me stop there.
Great. Thank you.
So I wanna I wanna say a few words and that, well I do so I wanna ask my fellow commissioners if they have questions for comments they wanna make before we look at a motion of possible motion to I use the rate hand, so I'll come to you in order in just a minute.
I wanna start by thanking director Bon for, his efforts in the last week to,
last three weeks really to to look at fashion this this measure,
proposed measure,
or working with us over last week and direct an department to work with us to find a way to make this meeting work, and and I hope most people feel it worked pretty well.
Perfect is never achievable, but I think it was
quite amazing how well it went and and how we're able to take public comment in a flowing fashion
after, you know, a false start last week. I wanna thank the department staff for all their work on this. I wanna thank Jordan
Sub for her great work on on
communicating what had happened and what we really were doing because I think that made a huge difference in terms of, people's understanding today. The staff of the commission has been unbelievable. We have a very tiny staff who have a ton on their plate under normal circumstances,
and this, both the technological challenges is making this work,
and the actual substance of it added an enormous amount of work, I particularly wanna to thank are incredible executive director who has been working seven days a week,
longer hours than I that I can imagine to make this happen and I wanna express the gratitude of the commission and and for the state
for Mill or leadership and teamwork. And I wanna thank the public who participate participated today. Again, as Director Bottom said people were respectful, they had thoughtful comments,
that we're helpful and productive, and, I know we're gonna take them in consideration as we now,
I'll move on to commission discussion.
Let... Man, and I like to ask
director. I mean, exact director. She make a comment to and I see that that one commissioner has a like gas Go ahead and. I just like to build on your statement about the public comment, and we do recognize that there were, you know, some technical glitches today, and we're able to work around them mostly.
We do are aware of my handful of people who were not able to get through
but we also
recognize that for some of those comments,
we we've had conversations directly with them and have a a relatively good sense,
and we're trying to convey that to our,
commissioners.
But also wanted to highlight that we did have a tribal
representative who was attempting to connect earlier this morning when we were having some of our technical issues and,
wanted to highlight that the satellite knee eighth Nation would like to engage in a government government
compensation on this. That's it.
Sure we, we will certainly do that.
Commissioner Maria, see if you have your hand rates, please. Chime in.
Yeah. And and I don't have a question as message I just wanted to make a few comments based on everything we heard if that's okay. That's of course. And then after you all call on,
Commissioner Officer Conversation.
Great. So I wanna echo all the banks to tribes elected officials numbers of the public for your engagement and
absolutely express my gratitude to,
to all of our fifty and commission and department professional by staff
for the thoughtful and thorough
economic and fiscal impact statements,
in particular, that analyze these sort of twenty five fifty, hundred percent
fishing or restriction and scenarios for economic impact. Those impacts are significant, of course. And I I pre appreciate this being able to see the effort that's gone into aggregating that information, creating the tables and graphs found within the economic and fiscal statement. It's a a real testament
to the deli declaration and thought that has gone into this decision making,
and it inspires a lot of confidence in the kind of detail oriented approach that I think we can expect. As we tackle this moving forward.
On a personal note, I just... I... You know, I work full time outside of this position with the commission now remotely
at home with my two kids, we're six and seven while I also now home cool them. So I really do understand firsthand,
the important mental health benefits of getting
away being outside, commuting with nature.
Last week, my kids and I
we're lucky enough to to to purchase six live Ab from our local Southern California Ab farmer,
not only in an effort to support local businesses, but also to sort of connect with Nate to do something together as a family.
And I Again, I just... I really understand wanting to be able to get out on the water. I want to be able to go to the beach, hike on trails,
but the governor's order is clear. And right now, we have to balance those wellness benefits with the serious long term costs.
That it could have for our state's communities.
And I trust director or Bon to do that. And it's not because I don't trust us
as the sufficient game commission,
or because I don't trust local government to manage these
themselves.
But we heard at the top of the meeting that different counties
have different requests, different concerns, different needs. You know, Those of Mona and Inn,
Trinity Del, El dorado. They're all... They all have different priorities in balancing short term economic gains with long term public health.
And I really see that director bottoms can act as a clearing house for those wolf of requests, while acting as point person with president Sk
in considering and taking action in a way that is
both surgical
and keep the comprehensive
statewide landscape in mind.
I trust that director Bon can balance equity and access
while also keeping mental health in mind for all
and can think about statewide impacts
and work to avoid inadvertently concentrating fishing effort in the remaining open areas, which I also heard from from some comment answers,
So I I think the director bon in consultation with Parsons Clark can act n in an emergency
situation,
not only to temporarily
suspend, but also to quickly reopen fishing in a timely way.
If public health, if and when public health recommendations and governor News guidance
allow it. We are not talking about a blanket closure today, there is expressed accountability to us at a game Commission
that is built into this emergency
regulation, you know, it includes reporting back to the commission on any decision made,
and it's not open ended. It expires May thirty first. So for these reasons, I just wanted to, to lay out these reasons. So but I... I I will be supporting this temporary emergency
regulation.

Yes. Thank you, President Sal. I also want to extend huge thank you and
appreciation to Melissa and efficient Game commission staff as well as director Bottoms.

that you have really done a great job today in Laying out,
director bottom and president Sk. That the Phishing Game commissioned together with the department
we really do understand.
And
I believe that we have built trust, I believe we will
continue to build trust
with the fishing community. And I think today's call really exe emphasize that And I do believe it should be a case by case basis
with local control,
and and I also
know that president
Will reach out to us
individual commissioners.
On those case by case basis,
if he feels that more input is needed, and we have the ability to also give our input to
president Clark.
And
I really think that everything that we have done over the last several years is working towards building trust with the stakeholders
with the drives and with the,
leaders.

I also just wanna also just
so they're really support thing that the
commissioner Murray mentioned,
just about the great that department it to,
you know, I have a a very good legal and technical
basis for this action.
I also wanted to say that that they knowledge do it much better do they appreciate that. You know, we had
commissioner Mir and I had a heck of a time with our
our
permission meeting, you know, two weeks ago, our
So this was much much better one big improvement like kudos to everybody to put it together.
And, finally, I wanted to a couple of things. One is you, obviously, this is based on trust. And, you know, I think right now that you farm my.
And the commission are working really well together and, you know, it's... One of the commissioners really
support,
you know, the the efforts of the departments and work with our president to to to move as quickly as it's possible to
work for the counties as needed. So I, you know, that's, I think that's an indication of trust
level that we have right now the can department of the commission.
And just we'll add on that side and it's obviously, I think if the department work with the governor's office follow ups. It seems like Public calgary is about Would very important give some of the comments. There seems to be on confusion
about what the department commission can and can do.
So Just, you're, encouraged
the department work that again there's office, And how you get better get the board out.

I think that there was a lot of positive
feedback, both Pro and Con, it it truly to me reflected that people
got it and understand.

based on the record, the proposed action is exempt from the California Environmental Quality act as an action necessary to prevent or mitigate an emergency as specified in section two one zero eight zero p b, p four of the public resources code.
Pursuant to section one one three four six point one of the California government code and emergency
situation exists.
The proposed regulation is necessary to address the emergency,
the emergency
situation clearly poses
such an immediate serious harm that delaying action to allow further notice in public comments after this meeting would be inconsistent with the public interest.
And that immediate action is reasonably
expected to prevent or significantly
alleviate that serious harm.
Therefore, the commission adopt the emergency
