Speaker 30:50

Okay. So this is part three of that three part series.

Speaker 30:53

This particular

Speaker 30:55

episode, they they basically open it up to general comments from the public.

Speaker 31:00

And, again, they're you know, they're... That this was...

Speaker 31:04

Concerning suspending delay in or restricting,

Speaker 31:07

sport

Speaker 31:08

and recreational fishing in California to Covid nineteen. They open the floor to anglers like ourselves.

Speaker 31:15

So take a listen, And right before that, I wanna play a message from Cal trout.

Speaker 41:59

Hey, guys. It's is Mark Smith. Can you hear me? Come good morning, Mark. Congratulations. You're on.

Speaker 42:05

Hallelujah.

Speaker 42:06

Apparently, I'm old enough to be technological technologically challenged now. So, I apologize.

Speaker 42:11

Thank you for working with me.

Speaker 42:14

So, I do wanna echo the comments that other members of efficiency community you've said, by the way, I'm making these comments on behalf Northern California Guides and Sports

Speaker 42:22

Association. I know that James Stone, the Executive Director was trying to get on as well, and I'm not sure if he'll be successful.

Speaker 42:28

I think we want to start by thanking the commission and the department for

Speaker 42:34

recognizing that leadership starts at the top and that

Speaker 42:38

communication and clarity are key.

Speaker 42:41

I think that we all recognize that, the community had a much better understanding,

Speaker 42:48

after what happened last Thursday about the intentions of the commission and the department moving forward. And so again, want to commend the director,

Speaker 42:57

Human to President, the staff and others who worked so hard communicate with us as representatives of the fishing community to help get the word out to others.

Speaker 43:07

I think we want to acknowledge a couple of points. The first is that

Speaker 43:12

creating

Speaker 43:13

solutions for some counties is going to

Speaker 43:15

inevitably caused problems for other counties. And by that, we are concerned about a pressure shift. We've seen this with the inland fishing on the Sacramento river and the tri.

Speaker 43:24

We saw this with Ocean Salmon and it was one of the reasons why the Salmon advisory sub committee made a recommendation to the P to delay the season opener

Speaker 43:34

when the ramps and other opportunities for access are being closed it divert that focus to other places

Speaker 43:41

Rightly, or wrongly, I've heard people talking about stay at home orders and restrictions sustained within your own county. I think we need to recognize that there is going to be travel as both attempts to do outdoor recreation.

Speaker 43:55

And that is just a reality that we need to live with and the fact is that that these actions are going to cause unintended pressures in other places. So to that, we have several questions.

Speaker 44:05

We recognize

Speaker 44:07

today that there are three counties that are requesting closures.

Speaker 44:10

When staff comes back and provides comments later, we'd like to ask

Speaker 44:15

what the process will be for other counties moving forward.

Speaker 44:18

And the opportunity for the public to participate in those

Speaker 44:22

conversations relative to those counting if they make those requests.

Speaker 44:26

Second, we'd like to ask for

Speaker 44:29

clarification on a process for resolving discrepancies

Speaker 44:33

between any directive coming from the governor's office

Speaker 44:36

and individual requests from specific counties

Speaker 44:39

related to

Speaker 44:41

stay at home

Speaker 44:43

access to outdoor opportunities, I believe that as we move forward,

Speaker 44:47

and the governor has started to talk yesterday about what the next steps for the state are,

Speaker 44:53

that there will start to be discrepancies

Speaker 44:56

between regions and the state. And I think it would be helpful for the director to provide some clarity on how we're going to resolve those discrepancies.

Speaker 45:07

Finally, we put this in our letter and this is not the appropriate time in place to get into it entirely, but we do remain concerned about the delegation of authority from sufficient gain Commission outside of its body to other jurisdictions. In this case, the department. We recognize that the pandemic

Speaker 45:26

is something that we've never experienced before. We recognize recognized that these are

Speaker 45:30

unusual times. We also recognize that we could be back in a situation in the fall in the winter

Speaker 45:37

when we're talking about doing something like this relative to hunting.

Speaker 45:41

This could be a seasonal virus, this could be something that we go through.

Speaker 45:46

I'd really appreciate some thought and some attention from the commission and the staff as to

Speaker 45:51

how to deal with this the next time that comes around.

Speaker 45:54

We encourage the commission to retain its authority vested in it by the constitution and the appointments provided by the governor in each of you,

Speaker 46:04

to be the end all be all the determining factor of these decisions. Again, thank you for the time and the opportunity to speak today and,

Speaker 46:13

really appreciate it.

Speaker 56:15

I wanna make two comments. One is we're gonna limit each speaker to one minute, we'll be timing that and we'll we'll ask you to stop at one minute and cut you off if you keep going. And the total amount of time, unless any other pictures wanna raise their hand and suggest that we do a greater time. The total time is five five hours with the number of speakers in line. We won't get anywhere near that. But we are limiting the total time to five hours, which begins right now at, eleven fifty.

Speaker 56:39

Alright. So, Lauren, please don't unmute the first speaker. Okay. Kate Cross in San Diego.

Speaker 66:44

Okay. I'm I'm glad you got to go. I'm glad you got to go first congratulations congratulations congratulations and to thank so much your patience. And thank you guys for doing this meeting. You know, I can't thank you enough for letting us have our voices heard.

Speaker 66:58

My concern is that although the meeting is mainly about the trout season, the outcome could have the potential to shutdown fishing everywhere, whether fresh water or salt water.

Speaker 67:11

San Diego has already completely banned us from fishing. The closure can be viewed on the Port of San Diego website. We can't fish for food on any of the waterways.

Speaker 67:22

In fact, my husband and I can't even take our boat that we live aboard out. To go to the ocean and fish.

Speaker 67:28

San Diego County has closed the harbor and our access to the ocean. We're completely self contained to go out and catch your own food. It would be much safer than going to the supermarket and exposing ourselves to other people

Speaker 67:41

and the poor cashier years,

Speaker 67:43

but it's not really working out very well here.

Speaker 67:46

Henry Kissing once said, whoever controls the food supply controls the people.

Speaker 67:51

We're already hearing about shortages or disruptions in the Us food supply chain

Speaker 67:57

particularly in the meat industry. Folks will meet the fish.

Speaker 68:01

Our local and state officials must not prevent people from feeding themselves.

Speaker 68:06

Please don't restrict our bill ability to fish.

Speaker 68:09

We really don't want the government to to take care of us. Thank you so much.

Speaker 58:16

K. Thank you. And thank you for your patience. I just wanna answer your question because you were so patient and in waiting for us. Yeah. Local ports are not under the fishing game nor the Department of edition Wildlife

Speaker 58:25

jurisdiction.

Speaker 58:26

In general, our goal here is to allow it as many people

Speaker 58:29

fish as safely as possible and we wanna encourage local authority to do the same when it doesn't interfere with proper social distancing. And I wanna let the director bottom at alignment and what hear yourself. K. Yes.

Speaker 58:41

For one

Speaker 58:43

additional detail

Speaker 58:44

as an example,

Speaker 58:46

the ground fish sport efficiencies season and,

Speaker 58:49

I did open April one,

Speaker 58:52

certain parts of the state.

Speaker 58:54

And

Speaker 58:55

damage management

Speaker 58:58

decisions are proceeding

Speaker 59:00

or

Speaker 59:01

polling openers,

Speaker 59:03

and that's occurring at the federal

Speaker 59:06

level

Speaker 59:07

at a federal account.

Speaker 59:10

Thank you for your feedback.

Speaker 59:11

Yes. Thank you thank much. Appreciate your call. Next time please.

Speaker 59:16

Lauren, please. Thank you. Yes. This Corey. Sacramento. I was calling.

Speaker 59:20

Hello, You didn't get Corey. Please. Go ahead. Thank you for joining us.

Speaker 59:24

Thank you. Yeah. The part of my concern here is other states open they're fifties early, and I see a pretty more from, like, previous color markers stated that with he ban it and some counties are stopping at in some counties that they're pretty people to the other counties. And so you're really not slowing or stopping the spread. He's gonna let's scan the spread.

Speaker 59:43

People want it is essential if people see their families again, like the previous car the state... And they renegotiate it that, you know, people need to see their families. That is part of essential leaving.

Speaker 59:53

You know, it is the domestic violence calls, the

Speaker 59:57

increased depression calls and stuff on the outlines we're getting worse because people can't get out and enjoy themselves. Well, when you're out fishing, I I don't know anyone that really sits more than six foot

Speaker 510:07

apartment fish fishing. I mean it's pretty hard to cast the pull or or, you know, hook somebody if they we stand a little closer than that. So this is this is something to me that is it is far fetched. Yeah. I understand it's only for a few counties. But at the same time I see it is probably gonna extend the other county. If we allow this to continue. And it's something that really shouldn't. You know, I'm sorry for those counties and they feel that they may have a problem controlling because they don't have enough staff for So,

Speaker 510:32

but that's also up to the county to then you know, mandate or get that staff to do so. As I... Know, other cities and Counties are actually changing their staff that just got some people sitting home to put them in vehicles to to assist with it the other

Speaker 510:45

enforcement or people don't to notify the public, you know, six foot distance and and help keep people at home. So please please not not limit these counties and and do not

Speaker 510:56

prolong the fishing. Actually, it'd be great if we followed other states like Philadelphia Vermont so forth, where they actually increased or we're opened early for people to fishing and provide further damage. Thank you. Fred, Laura, this is James Stone. Can you hear me?

Speaker 511:12

Mister Stone. We can't hear you. I'm glad you made it through. Thank you. Please go ahead.

Speaker 611:16

Thank you very much. I've been trying since the beginning,

Speaker 611:19

a, presence Clark, commissioner, staff, as well as department staff. Thank you very much for the communication since the past mission meeting, we really appreciate

Speaker 611:30

all of the dialogue to try to put out the correct back to the fishing community.

Speaker 611:34

I think that, unfortunately, with social media and how fast that rumors can spread a lot of

Speaker 611:41

misinformation was put out there. And so we wanna thank the department for putting out the fact sheet and for clarifying exactly the intentions of this emergency meeting.

Speaker 611:50

We also wanna thank a commission for not just doing a right closing the entire state and painting it with a broad brush. We we appreciate you... You guys not go in that direction.

Speaker 612:02

Recreational fishing as you know as bio from the outdoor recreational community, and a lot of people can still get outside while properly social distancing team and enjoy the outdoors through fishing.

Speaker 612:15

We do respect the surgical

Speaker 612:17

approach that the director and the certain county, the requesting and taking on a county by county basis

Speaker 612:24

strictly due to board of supervisors or public health officials announcements

Speaker 612:28

rather than just trying to do an alt right closure.

Speaker 612:31

As you know as well, our fishing guide community was deemed none essential on March sixteenth by the governor's order, and the guiding community is hurting like many other businesses right now, and it's spiraling down a a tube that we don't know if we can ever recover from.

Speaker 612:47

We appreciate any clarification on that in the future, and we also would make recommendations of the department to continue with fact sheet weekly if not, bi weekly, that could at least.

Speaker 613:00

And now what waterways

Speaker 613:02

are currently still open and and and and are not closed because the misinformation out there causes a lot of confusion and then causes rumors that you're gonna shut down the entire state. We appreciate everything you're doing and thank you very much for this time.

Speaker 513:18

Thank you, mister Stone. Next caller, please.

Speaker 613:21

Marilyn and Jasper public interest coalition, we totally support authorizing director bon to make proposed critical decisions as needed to stay ahead of

Speaker 613:32

potential problems,

Speaker 613:35

instead of too late reactive

Speaker 613:37

in order to protect not just locals, but all people.

Speaker 613:42

That said, to avoid enforcement nightmare

Speaker 613:47

and

Speaker 613:48

increased risks to wildlife officers

Speaker 613:52

if areas are closed,

Speaker 613:54

the order must apply

Speaker 613:57

equally to all,

Speaker 613:59

no exceptions.

Speaker 614:00

Any exemption for groups

Speaker 614:03

organizations local or other reasons will compromise

Speaker 614:06

both the order

Speaker 614:08

as well as safety for all of us. We greatly appreciate the commissions taking this responsible action. Thank you.

Speaker 614:17

Thank you for calling me in next speaker, please. Good afternoon. This is Stacy Heat from the Rural County representatives of California. Can you hear me okay?

Speaker 514:25

Yes. We can. Stacy. Go ahead, please.

Speaker 614:28

Alright. Great. Thank you. We represent thirty seven Rural County Statewide and you've already heard from a whole bunch of our members today, so I won't

Speaker 614:36

go on too long, but I just wanted to, back up and so court those three counties that have made this request. And also, I believe Sierra County has made a similar request as well. I have their letter and I can forward that to you if you don't have it on file.

Speaker 614:53

What our

Speaker 614:54

request in support of this is to be on the request of the local government as we've seen to the four county so far

Speaker 615:02

to allow director bottom to work with these local governments. And if any other local governments have difficulties in the near future

Speaker 615:08

write these counties. Some of these smaller counties. They just don't have the capacity

Speaker 615:13

to deal with a lot of outside residents coming in for the upcoming fishing season,

Speaker 615:17

and, you know, they don't have the... Neither the staff nor the financial ability to deal with this. And

Speaker 615:25

we support their request and wanted to make sure that as we've spoke up on our behalf. So thank you for

Speaker 615:32

undertaking this today. Thank you.

Speaker 515:35

Great. Thank you very much. Next speaker, please.

Speaker 715:38

Hey. My name is Zach Pierre. I was just calling. I would like to to agree as Ever... Most everyone, I believe with

Speaker 715:44

the fact that it should be county by County.

Speaker 715:47

Being in the military. It's not as easy to pay for food. We have discounted food, but the same time in order to actually save food or money,

Speaker 715:57

it is easier to go fish.

Speaker 716:00

And I believe one other car said it it... While fishing, normally speaking,

Speaker 716:05

you're not right on top of others.

Speaker 716:07

So

Speaker 716:08

you can...

Speaker 716:10

Or practice your social distancing thing while fishing and

Speaker 716:14

fear fishing whatever kind of fishing you wanna do, you can maintain social distancing.

Speaker 716:19

And still be able to effectively fish.

Speaker 516:25

Great. Thank you, sir. Appreciate your time. Next speaker, please. Okay. Great. My name is Dennis. As I live in bought Porto,

Speaker 816:32

Blue County.

Speaker 816:34

I live a hundred feet from the river,

Speaker 516:36

logged this twenty miles stretch of river that opened up in April four.

Speaker 516:40

And just to say, I yet to see there are been beside myself on there.

Speaker 516:44

I do use it full food.

Speaker 516:47

Anyway,

Speaker 516:48

I think everything's been discussed about,

Speaker 516:51

also a distancing in the counties that need to close. And,

Speaker 516:55

my main thing is, I think people are coming, you know, the the travel.

Speaker 516:59

Ban. I mean, you know, stay at home isn't being listed South like those is a good example.

Speaker 517:05

The thing about it is you have thinking it out to the people. If I go to

Speaker 517:10

Google and I do California camping campground,

Speaker 517:13

and there four hundred pages about how the state campground grounds in the state to in the State park are lot in the state state state states.

Speaker 517:22

Very, very few people know that the National Court campground are very few. If you wanna... You can't stop people from traveling. They're gonna do it. But many you can discourage people with all the campground. I think a massive media push

Speaker 517:37

saying everything's closed.

Speaker 517:39

The campground clothes, the boat ramp for clothes, the motel are closed. Everything is closed, please don't come. No one knows that the asshole force.

Speaker 517:48

Campground are closed. You have to go to each individual site and ac. Click on the campground

Speaker 517:54

at lake Davis that you wanna go to before you run into is closed.

Speaker 517:59

Massive media, people

Speaker 518:01

in the Bay area don't know that the not so before campground are closed.

Speaker 518:05

The average person. So they come up for her with her trailer,

Speaker 518:09

and their motor home, and then there's a old park on a dirt road somewhere.

Speaker 518:13

You just have to get the word out. You know,

Speaker 518:16

it's closed.

Speaker 518:17

Anyway, I think you guys are doing a good job. And I think surgical

Speaker 818:21

is gonna be good, but that's all I have to today. Thanks.

Speaker 518:25

Next speaker, please Go ahead, sir.

Speaker 518:31

Good morning.

Speaker 518:33

Morning.

Speaker 518:34

Hi. My name is Sean Nash, and I would just like to inform anybody trying to get into the queue,

Speaker 518:40

just to let you know that you have your raise. Once you press pound two, it should come over the speaker and let you know that your end is raised.

Speaker 518:47

I know some people around me were trying to get it and it wouldn't come up.

Speaker 518:51

I would just like to start by saying good morning for the members of the board. And instead of sitting here and complaining and adding problems to the situation. Instead, I'd like to propose some solutions that would benefit both parties of the argument.

Speaker 519:03

I'm proposing that all commercial recreational and saltwater vessels be allowed,

Speaker 519:08

continue to fish as they provide the safest of distancing being isolated from the public. And to address all others such as peers lakes. And both private fisheries, both fresh freshwater and salt,

Speaker 519:19

maybe we should put in place a minimum safety distance between anglers that could be pun punishable if broken. And require that all anglers wear protect protective face masks at all times.

Speaker 519:31

As a prior trout hatch... Hatch worker myself. It would not only hurt the hatch, if fishing has been closed,

Speaker 519:39

because hatch cannot continue to produce fish, if dish are not caught, bought and sold. It would leave a backlog of problems that would only hurt hatch and stock lakes in the long run.

Speaker 519:50

Private hatch trees,

Speaker 519:52

stock over thousands of lakes in the Northern and Southern California areas and are not effectively equipped.

Speaker 519:58

Stalled sales for this long, and we'll have extraneous amounts of die and backlog that will affect private lakes for many years.

Speaker 520:06

Again, I'd like to thank everybody for my time, and I'd like that off.

Speaker 520:11

Great. Thank you very much. Next speaker, Lauren.

Speaker 520:14

Thank you, sir.

Speaker 520:15

My name is Bob Smith, and I live in a,

Speaker 520:18

remote remote rural area of Swallow County, and I just wanted to comment. I think people are focusing too much on

Speaker 520:25

the

Speaker 520:27

The social distancing of actual fishing itself and not thinking about the travel aspects that go into this.

Speaker 520:34

Our local market here is small, very tight. There is no social distancing possible, the gas stations,

Speaker 520:42

have

Speaker 520:43

small restrooms available,

Speaker 520:45

everybody who drives up here,

Speaker 520:47

from, more urban areas are stopping at each one of these locations.

Speaker 520:52

And with the potential spreading

Speaker 520:54

this virus. And so it's not just about social distancing on a river, which is easy to do, or, on the ocean on your boat. It's about social distancing when you are traveling and the exposure you're putting on these rural counties,

Speaker 521:08

and that's all I have. Thank you. Good. Next speaker, please. Hey. This is Ike go

Speaker 521:14

team Fish gang, San, California.

Speaker 521:16

Well, being that everything is still open and, I understand where you guys are coming from all the closures in most, certain counties.

Speaker 521:26

Here fishing as far as all the peers that are closing within San Francisco in the Bay area,

Speaker 521:32

will we know when they will be reopening those or as that part of what the government's plan is the governor's plan I'm sorry.

Speaker 521:42

Thank you. So we'll what we'll get to that and, when we wrap up a nick caller, Lauren.

Speaker 521:47

Hi. This is Aaron Now was calling in from San Diego.

Speaker 521:50

I do wanna highlight that it sounds like we got forty people in queue.

Speaker 521:54

We did have about four hundred call last week. So technical difficulties is are probably part of the issue.

Speaker 522:01

If you guys need to shut down three counties to protect the people up there. I understand that but change the emergency order to say that. We're in San Diego, our rights have been taken away I can't take my boat from its slip out to go fish. I can't take my son out of the house to go to to do that and social isolate.

Speaker 522:17

Once you lose your right, they're gone. They're hard to get back. I understand it's gonna expire May thirty first, but there'll be a agave extension after that. Please

Speaker 522:26

As you said, surgical focus this where it needs to go, which is those three counties and nowhere else. Thank you.

Speaker 522:33

Thank you, sir. Next speaker, please.

Speaker 722:43

Hello. My name is Steven Both. I'm calling from Orange County, California.

Speaker 722:47

Can you hear me?

Speaker 722:48

Yes. We, sir. Go ahead, please. Hi. Go ahead. Calling to... To disagree with what the state's proposing an in the D proposing. Like the last caller, I've been lockdown after for six weeks already. We cannot fit. We cannot go to the ocean and surface fish. We cannot get on a boat to fish the peers are closed, the jet that closed, the local lakes are closed. The strings are closed. If this is not fair that the D is considering closing fishing for all Californian

Speaker 723:15

because a couple small cities decided we don't want visitors.

Speaker 723:19

And like we heard their their politicians speak earlier in this meeting. They don't want

Speaker 723:24

visitors to come and fish. It it should be left open to the locals they... But they bought all means don't step on their rights. Just stop on the right of those flat lenders down there that that are disease. And wanna come up here to the mountains. This this is...

Speaker 723:37

I absolutely in insane. The state of California has told me, I cannot I cannot provide for my family, you can only go to state approved store and by state approved goods when they're available. I don't know about the rescue. I've been to the store three times in the last month. There was no meat. There was no chicken I was four your. One minute is up. Love to let you wrap up if your like.

Speaker 724:00

Okay. And. So, please, don't do this. This isn't fair to all Californian.

Speaker 724:05

And and and it would be nice at the Ds or might be able to get

Speaker 724:09

the low...

Speaker 524:11

Direct about it but say we're.

Speaker 524:13

And so

Speaker 524:15

I said

Speaker 524:17

theme

Speaker 524:18

some of the come

Speaker 524:20

and instead of waiting to the end to address questions,

Speaker 524:24

I would just say,

Speaker 524:26

as to the ocean,

Speaker 524:29

in coastal counties,

Speaker 524:33

the department has not closed

Speaker 524:35

fishing in the ocean.

Speaker 524:38

And

Speaker 524:39

aspects of access

Speaker 524:42

in the coastal zone, are local decisions, tears,

Speaker 524:47

arenas

Speaker 524:48

ports.

Speaker 524:49

Those things are not

Speaker 524:51

included within

Speaker 524:53

the proposal in front of the commission today.

Speaker 524:56

In fact,

Speaker 524:57

in the ocean, the ground season is open

Speaker 525:03

the

Speaker 525:04

original

Speaker 525:05

opening date of Salmon was moved back just thirty days.

Speaker 525:10

But shortly, we will have additional information out to the public.

Speaker 525:15

About all of the

Speaker 525:17

upcoming openers

Speaker 525:19

relative to Salmon recreational in the ocean

Speaker 525:23

and confirming those dates.

Speaker 525:26

So some of the frustration we made here in this call

Speaker 525:30

may more likely be about

Speaker 525:34

access points that are really subject to local jurisdiction,

Speaker 525:38

not the commission nor the department, certainly not in the proposal

Speaker 525:43

presented this one. Thanks.

Speaker 525:46

Thank you Congrats. Next speaker, please.

Speaker 525:55

Hello?

Speaker 525:56

Yes. Go ahead, sir.

Speaker 825:58

Hey they're sorry to pull over.

Speaker 526:01

I guess for the most part, but I would have been saying already been covered in a great way. So I guess, it's to endorse my process that I think it should be county county.

Speaker 526:09

I think I fixed a lot of issues shutting individual ones down.

Speaker 526:13

Altogether, I don't think would be very effective in long run for, you know, recreational fisherman or the fish species in the themselves.

Speaker 526:21

Pretty much all I got. Everything else has been reiterated.

Speaker 526:26

Thank you, sir. Next speaker.

Speaker 526:34

Go ahead, sir.

Speaker 526:35

Ma'am. Hi hey. Jake Vince calling from San diego California. Thanks for hear me out for my one minute.

Speaker 526:42

But I have no voice to the help line. I had to click it six times before picking, so keep trying in the help line is nobody's getting through on the help line it's automated in the backlog. I just wanna talk real quick on public trust.

Speaker 526:54

You guys do.

Speaker 526:57

I think you're gonna lose a lot of it and bi that I means ban and Pushing for, any of the counties

Speaker 527:03

concerned or anybody outside of. The ability to do so. Not granted you. Under at the California

Speaker 527:08

constitution.

Speaker 527:09

Specifically, article alarm session twenty five. All fisheries have not been closed true as you've many had mentioned, a precedent is being set here with a lab voice the board

Speaker 527:19

that that municipalities is that likely used and they're finding

Speaker 527:22

to justify farming that they make within their county such as San Diego.

Speaker 527:26

This local is only attitude is, is garbage, my parents for likely better word. You know, we can fish our waters, that you guys can't, meanwhile, those locals have the ability to go travel and see their loved one and come back infected and still spread the disease. Don't worry.

Speaker 527:42

I'll find Neo while I will not put a dime of money into your economy in the future.

Speaker 527:47

But I do want the ability to fish my California waters it's guaranteed to me about the constitution. That's all I have thanks.

Speaker 527:54

Thank you, sir. Next speaker, please.

Speaker 528:00

Hi. Can you hear me?

Speaker 528:02

Yes. We can. Go ahead, please. Hey. Alright. Thank you. That my name is Greg Holt. I live up in Plaza County.

Speaker 528:08

I don't wanna repeat what People said about people named food.

Speaker 528:12

County governments are already restricting or barring access to phishing, phishing sites and being able to get out there and do that. This request moves the burden of responsibility from local lack of officials. To an una elective state agency. So I would suggest that you leave local governments to enforce their local

Speaker 528:28

regulations.

Speaker 528:29

They're already in contact with the constituencies.

Speaker 528:32

I think it's gonna damage the trust between anglers and hunters

Speaker 528:36

and the department of efficient Wildlife.

Speaker 528:38

If you assume this responsibility and authority. Thank you.

Speaker 528:43

Thank you, sir. Next speaker, please.

Speaker 528:48

Yes. This is part. This, Eric Wood, I wanna do

Speaker 528:52

agree with the article one section twenty five gentleman.

Speaker 528:57

According to the constitution, we don't even need a fishing license. So I won't need to say in play in English,

Speaker 529:02

are we under

Speaker 529:04

the spending the

Speaker 529:06

constitution,

Speaker 529:07

We're under Mitral,

Speaker 529:09

State Play in English.

Speaker 529:14

Is there??

Speaker 529:16

Is that it, sir?

Speaker 529:18

Hello? Can you hear me? Yep. Is is that is that is that the end of your comment?

Speaker 529:23

Well, that and I want answer to it. Plain English.

Speaker 529:27

I've you been it we don't to have Time. We'll discuss all you, and thank you very much. Next speaker, please.

Speaker 829:39

Hi. My name is Philip Scott. Name I'm in Place County.

Speaker 829:43

I was looking at the draft emergency statement, and there is a lot of talk about surgical

Speaker 829:48

effort

Speaker 829:49

on this. Proposal. However, looking at the proposed Greg Report language subs section b, it says the department shall temporarily close or restrict,

Speaker 829:59

and then what the things that they will consider.

Speaker 830:02

The surgical

Speaker 830:03

criteria

Speaker 830:04

that you actually need to have in that provision is found in the draft

Speaker 830:09

informative digest.

Speaker 830:11

Specifically the areas or regions where large gatherings of fishers have been historically known to occur areas where new gatherings are occurring

Speaker 830:19

water or areas that experience a significant number of non res fishers or areas of regions that have limited

Speaker 830:26

emergency and health services availability.

Speaker 830:29

Votes, that's the criteria

Speaker 830:31

that you should be making the decision on the proposed regulation does not reflect it. Therefore, the proposed regulation is extraordinarily broad, and that's why a lot of people are

Speaker 830:42

opposed to this proposal.

Speaker 830:44

And so the other thing to that I wanna point out is that you could also suspend non res licenses if you wish to do that something like that instead of,

Speaker 830:53

doing a broad

Speaker 830:55

blanket brush.

Speaker 830:57

The other thing is if you do it by county,

Speaker 830:59

then what if the waters river streams goes or or lake process into other jurisdictions, you have and it's only one area that you wanted do. Three minute is up wrap up. Okay.

Speaker 831:13

Yeah. The the last thing is is that I wanna... The

Speaker 831:16

the reopening of the, waters under subs section c,

Speaker 831:21

any order that is given under subs section b would automatically

Speaker 831:26

be ineffective on June one, even if the waters are not been reopened under subs section c, and that would

Speaker 831:35

that needs to be clear under subs c.

Speaker 531:38

K Thank you. Next week, please.

Speaker 531:46

Yep. Hello.

Speaker 531:48

Yes. Go good, Terry.

Speaker 531:50

This is Vol hone with the Water Alliance.

Speaker 831:53

People how are you? First of all, I I wanna recognize the commission for showing a lot of constraint

Speaker 831:59

in in managing the fisheries during in this crisis.

Speaker 832:02

We support disease the pause of May thirty first,

Speaker 832:07

and

Speaker 832:08

also support ace elective

Speaker 832:10

specific disclosure.

Speaker 832:12

They not burn is that the event that the closest community

Speaker 832:17

could you ask for special closure that that been denied. Thank you.

Speaker 532:22

Thank you, sir. Next speaker, please.

Speaker 532:36

Hello. My name is Will Withers from Huntington Beach California, and I just want to make a couple points.

Speaker 532:42

First off, I understand that this can daniel's pandemic there's obviously a lot of new things going on and there's another clear

Speaker 532:49

clear direction I was where to go.

Speaker 532:51

But a couple points, I wanna make regards to this. Is that first, I wanna make sure.

Speaker 532:56

That there is clear and defined measure

Speaker 532:59

of what we'll define opening up,

Speaker 533:02

the efficiency season

Speaker 533:04

up there as it's already kind of been...

Speaker 533:07

You know, it seems like you... The decision has already been made in some aspects

Speaker 533:10

so Gap governor news will likely not just open the flood gate and say, hey, everything's open now. There's likely gonna be a phased approach,

Speaker 533:19

and he will specifically not call out t scenes in the Eastern sincere. So I'd like to see some verbiage defining what it is that were linked to,

Speaker 533:28

that would actually say that the season is now open or able to be open.

Speaker 533:33

The second one point I wanna make is around establishing precedent.

Speaker 533:38

As most the people here have

Speaker 533:40

made to people in San Diego County. Know. I know that the Fishing game commission has not typically c closed Fishing in

Speaker 533:47

San Diego, but our access to

Speaker 533:50

the ability to fish has been severely limited.

Speaker 533:54

So the cities and insurance sierra should be responsible for controlling access similar to other,

Speaker 534:02

cities around the state,

Speaker 534:04

they can control that access by closing hotels,

Speaker 534:06

closing long ramps, closing things like that. That's how they can mitigate the influx of people coming up there. But they're the Daniel commission taking this sir. Ask you to wrap up your minute is after Go ahead and finish it up.

Speaker 534:18

Vision game is going to be overs stepping their boundaries

Speaker 534:21

by closing specific

Speaker 534:24

regions. And if she get some cities to manage the influx people. Thank you. Thanks thank you, sir. Appreciate it. Next call please.

Speaker 834:36

Hello? Can you hear me?

Speaker 534:39

Yes. We can Hello

Speaker 834:42

Okay. My name is Jacob Long. I'm an angle and resident of Northern California.

Speaker 834:47

I'd like to urge the commission to allow to the maximum extent possible,

Speaker 834:51

access to recreational fishing and shellfish fishing.

Speaker 834:55

Recreational sport fishing is a crucial means of providing healthy food for one oneself,

Speaker 834:59

allowing the ability to provide food for oneself is more important than ever, as many of us are now without a job is standing on the bank of the ocean or a river cannot be more of a risk to our community than standing in line at a food bank,

Speaker 835:14

Additionally, social distancing could be practiced effectively while an.

Speaker 835:19

The budget for the department of Efficient game will be severely negatively impacted if thousands of people do not purchase a license in the coming months.

Speaker 835:27

Article section article one section twenty five of the California

Speaker 835:31

constitution, guarantee citizens the right, the access of waterways.

Speaker 835:35

Counties have no authority under California

Speaker 835:38

constitution to limit that access.

Speaker 835:40

Furthermore, I'd like to urge our elected and non elected officials to continue to uphold and defend the Us constitution as well as the California

Speaker 535:48

constitution. Thank you for taking my comments.

Speaker 535:51

Thank you, sir. Next speaker, please.

Speaker 536:00

Hello. Can you hear me?

Speaker 536:01

Yes. We can. Go ahead, please.

Speaker 536:03

Hello. My name is Kyle Brandt. Perfect like to thank you guys.

Speaker 536:07

For your concerns and efforts to protect the health and safety of Californian during this time.

Speaker 536:13

I'm an avid recreational angle and the majority of the food for my family

Speaker 536:18

comes from the beautiful Waters in Wild land, California.

Speaker 536:21

I believe that phishing can be done in a safe and responsible manner during this pandemic with guidance from Cd

Speaker 536:28

and local authorities.

Speaker 536:30

I urge you not to adopt the proposed motion that would allow Cd w to delays spend or restrict recreational fishing in certain counties.

Speaker 536:38

I believe fishing is now more important than ever for Californian as a safe and healthy outdoor activity, and a means of gathering healthy food to the table,

Speaker 536:48

especially now when so many grocery stores

Speaker 536:50

are devoid of fresh healthy food options.

Speaker 536:53

I believe this can be a great opportunity for Cd to rebuild the public trust between California's

Speaker 536:58

for California's Anglers and Cd

Speaker 537:01

through effective this collaboration. Thank you.

Speaker 537:05

Thank you, Sir. And before the next call, I just wanna remind everybody, we're starting to hear that the... For people we're repeat a lot of the things stuff, which which is fine. If you if you want to do that, you may, You have a minute. But if you if you have heard what you've said wanna say said before.

Speaker 537:18

Everybody would greatly appreciate if you say you endorse previous callers and just list a couple topics that that you wanna endorse. Thank you very much. Next caller, please.

Speaker 537:31

Yes. Go Good afternoon Commissioner.

Speaker 537:33

Hi. My name is Landon Pep, and I'm at a local level of Current County phishing game commissioner, and I also work for a California based on profit called the Wild Cons consultancy.

Speaker 537:42

I'm also having fly through She at just Sierra thirty days a year.

Speaker 537:46

Speaking on behalf of my organization, we closed our twenty preserve statewide where we hosted over a million visitors last year. We're following the governor's order, and we support the adoption of the the regulations and allowing Cd to take the necessary.

Speaker 538:00

Steps in protecting our

Speaker 538:02

local and public health and safety. Thank you.

Speaker 538:06

Thank you, sir. Next speaker, please.

Speaker 938:13

Yeah. This is my name is Scott I'm from Stan County. And I just wanted to kind of,

Speaker 938:19

voice my support for

Speaker 938:21

some clarification in the wording. A lot of the even the stuff coming out of your office here, does not specify that this is to be restricted to certain counties, and it really does sound like it's a statewide issue.

Speaker 938:35

I think that, I would also like to support the people who say, Yes. Standing on the bank of a river is about as socially isolated as you can get. Even the people you go with, you're not likely to be standing within six feet from. And the idea that the line at the grocery store is somehow safer than a boat ramp to me is somewhat ridiculous.

Speaker 938:56

I think that this is...

Speaker 938:58

Doesn't really have a whole lot of precedent in anything we've ever done before. And

Speaker 939:03

I feel like this is a matter best left to the individual counties.

Speaker 939:08

And that some level of just getting... As I was also said before, of getting the word out there to people that don't travel to these places,

Speaker 939:16

they don't have the facilities to support your travel right now, getting that word out there is the most important part

Speaker 939:22

and I don't feel that additional regulations are required for this.

Speaker 539:27

Matt G from Sacramento County and opposition of this proposal. After listening to leaders of the state commission this morning demon I and make assumptions about the responsibility of Anglers,

Speaker 539:36

I'm trouble that were presumed guilty of negligence until proven innocence.

Speaker 539:41

Fishermen do not

Speaker 539:42

do do not visit these counties unprepared or without knowledge of remote businesses will not be open. Let alone rely on those businesses to supply them with their needs in order to.

Speaker 539:52

We these businesses at higher elevation down to support the fishing and hunting communities. These businesses have now flows and there's not an ability from for outsiders to transmit the virus to operators these businesses and other residents due to their closure.

Speaker 540:06

Furthermore, if these counties wanna truly isolate themselves from other counties in fear that they cannot prevent the spread of Covid, they must take more extreme measures than not letting visitors on their highway to fish. So these counties are willing to stop all residents from leaving their home. Stop all deliveries from neighboring counties, and completely isolate themselves within in the state of California, the these counties should remain open to the crowd season. Commerce is a two way street. You do not get benefit from neighboring counties,

Speaker 540:32

delivery of supplies is goods, And then on the other hand, restrict those county from traveling and recreating safely and responsibly within your borders. Thank you guys for your time and consideration and listening to my voice.

Speaker 540:44

Thank you, sir. Thank you for calling. Next speaker, please.

Speaker 440:51

Good afternoon. This is Glenn with Big Red Worm company. I supply probably about fifteen different counties in California with bay products and tackle products.

Speaker 441:00

Okay. I do support the... County being able to decide whether they are open or closed. But on that note, I would like fishing games to also step in and let counties know that if they going to say that they are open that their ramps need to be open,

Speaker 441:13

and their base options need to be open. There are several bait shops right now because they don't sell any sort of drinks or toilet paper that are being forced to close,

Speaker 441:21

and they're gonna be closed for several months versus other stores that are open right now. So I would just like,

Speaker 1041:27

if we are going to give counties the option, if counties are going to be open, then they need to be open to

Speaker 441:33

The stores also supply these products that are essential for fishing.

Speaker 441:37

Thank you.

Speaker 541:39

Thank you very much. Next speaker, please.

Speaker 541:47

Yes. Go ahead.

Speaker 641:49

Hi. This is Laura Mills from Monterey County, and my husband and I are Avid Anglers.

Speaker 641:54

We fish

Speaker 641:55

in

Speaker 641:56

the Los Pad National Forest.

Speaker 641:59

And we are concerned about the financial impacts on the hatch trees. Most of the

Speaker 642:04

traditionally we do is planted trial that California pit fish and wildlife plant

Speaker 642:09

or recreational fishers.

Speaker 642:11

We're also concerned about the impact to four hundred L,

Speaker 642:16

which is federal land that had joined us. We have a lot of friends and neighbors that fish there,

Speaker 642:21

and that would be impacted

Speaker 642:24

on their recreational fishing.

Speaker 642:27

So we

Speaker 642:28

do support the counties that are requesting. This is the other speakers have stated,

Speaker 642:34

present present clark for for their own reason,

Speaker 642:37

but we would like to see the surgical

Speaker 642:39

approach.

Speaker 642:40

Applied to the rest of the county.

Speaker 542:45

Great. Thank you very much. Next speaker, please.

Speaker 542:53

Hi. This is Terrence Sullivan from

Speaker 542:55

California.

Speaker 542:59

Hello about? Yes, sir. Go ahead, please.

Speaker 543:03

Hi. I was calling in regards

Speaker 543:06

just great listening to this, and

Speaker 543:08

it's

Speaker 543:09

understanding

Speaker 543:10

everyone's concerns.

Speaker 543:12

One of the things

Speaker 543:13

Guess is

Speaker 543:15

far local pissing of, people from local areas,

Speaker 543:20

actually opening it up to

Speaker 543:22

sister county

Speaker 543:24

that are ordering,

Speaker 543:26

sometimes it might be

Speaker 543:28

easier for someone to,

Speaker 543:30

drive

Speaker 543:32

to a next county next door

Speaker 543:35

than it is,

Speaker 543:37

drive to

Speaker 543:38

another fisherman within their own county borders. So maybe more of a

Speaker 543:44

spread out earlier

Speaker 543:45

you know, a originally of about fifty miles or something like that they were,

Speaker 543:50

a lot of us go fishing

Speaker 543:52

at at other lakes in another county,

Speaker 543:55

in it's day use.

Speaker 543:56

So it might be an a hour drive back and forth,

Speaker 544:00

and it might be less of a approving,

Speaker 544:03

going all the way across your own county. So

Speaker 544:07

just take that in Thank you, isolation. Thanks for everything. Bye. Thank you, sir. Appreciate it.

Speaker 544:13

Next speaker, please.

Speaker 544:14

Benjamin and Drive her callback County supervisor district five?

Speaker 544:19

Supervisor. I'm

Speaker 544:21

I'm in support of a county the county decision with local surgical control.

Speaker 544:28

Some

Speaker 544:29

some of what the recommendation going forward today we'll need some words missing in order to

Speaker 544:36

request that verbatim.

Speaker 544:39

You know, we are we are in support of the

Speaker 544:43

health and safety of everyone in California at the same time,

Speaker 544:48

we we would like to the consideration that place places of

Speaker 544:53

congregation, boat ramp,

Speaker 544:55

stocks some restroom areas

Speaker 544:57

are some of the sites that would be the largest word more so than people short fishing that are managing maintaining social distancing.

Speaker 545:05

Thank you.

Speaker 545:06

Thank you, sir. Next speaker, please.

Speaker 545:13

Hello?

Speaker 545:15

Yes. Go, please.

Speaker 545:17

My name is Julian Frazier. I'm Martinez, California. I'm from a family that

Speaker 545:22

commercial fifth back in the fifties.

Speaker 545:24

I'm saying that because their fishing was taken away, and it was un unwanted because it was the

Speaker 545:32

it was the water project that that took the salmon out of the car strait, And I I'm afraid of things like this happening again.

Speaker 545:39

This issue should really not be in front of fishing game. The authorities, the the agency that addressed this issue are of state

Speaker 545:46

and the county themselves, and they're pushing this off to an agency that really shouldn't have this authority.

Speaker 545:52

It's travel.

Speaker 545:54

It's ultimately travel. And under the the shelter in place, we're not even supposed to leave the area of our homes

Speaker 546:01

for our counties.

Speaker 546:03

So there's means to enforce this, and it's rough, but there are means.

Speaker 546:07

California state is in

Speaker 546:10

control of the highway patrol. And if these counties need help to keep people from coming in. That's what they should do. There are other types of recreation that aren't

Speaker 546:20

being told, they can't keep things. And in one of the letters, they're saying the reason they want this because they're noticing people move in to their counties for other types of recreation. I just don't think there's this fair

Speaker 546:32

I don't think it's really surgical

Speaker 546:34

in that you're saying we're gonna go county by county. Sure. Or you're you're one it's up can you wrap up, please?

Speaker 546:41

Yeah. I'm wanna wrap up. The the the point is is,

Speaker 546:44

eventually, it could be the most state. County by County is not surgical.

Speaker 546:47

And I just wanna Alright. Thank you I don't you. Thank you.

Speaker 546:52

Appreciate it. Next speaker, please.

Speaker 546:54

Thank you for hearing me. My name is Serge Vas with Ford Fish gear and Expert Marine electronic.

Speaker 547:00

Carl Sword Club and Soc Flare club. I'd like to oppose any Ds measures restricting the abilities of Anchors to exercise their constitutional rights to fish. Furthermore, I'd like to see the department of efficient wildlife like more involved, In protecting anchors right to access these waterways.

Speaker 547:17

For example, what's going on is San Diego where anchors can't take and launch their boats to access the oceans, so they could

Speaker 547:26

provide for their own family.

Speaker 547:28

Thank you for hearing me.

Speaker 547:30

Thank you, sir. Next speaker, please. And I'm just gonna mention again, as Director Bottom says that we don't have authority over local ports and and what they're doing, we encourage you to work with your local ports to do that, but that's not in

Speaker 547:43

jurisdiction efficient game commission. So it's not up. Particularly helpful to keep hearing something that we can't do anything about just asking the courtesy of focusing on what the commission actually does next speaker, please.

Speaker 547:53

Hi mister President. Can you hear me?

Speaker 547:56

Yes. We can. Please go ahead. Hi. My name is Derek Frost. I'm a cons from Sacramento, California.

Speaker 548:02

Just wanted to reiterate a couple of things that I had heard on the call today, all the commentary I was very good both from the County officials in and the state, as well as my fellow, Californian.

Speaker 548:13

The diversity of the state to me is is really a challenge. Right? When we look at the the of Covid, it's it's heavily located in the Bay area, it's heavily located in the sacramento area, and it's heavily located.

Speaker 548:23

And other specific parts of the state, La, San Diego and and now unfortunately, run of county, which is really what's driving this.

Speaker 548:31

Adopting a a piece of or an emergency action that may be able to be applied unilaterally,

Speaker 548:37

the same way across the entire state at the that the limit counties is a little bit dangerous to me county And

Speaker 548:43

it makes me feel as though we're we're just setting ourselves up for a slippery free slope where

Speaker 548:49

you know, various counties see that

Speaker 548:51

this that they can... That they can lock people out of fishing or recreating successfully.

Speaker 548:56

And that translates downstream out counties. So I really challenge

Speaker 548:59

the commission

Speaker 549:01

to to think carefully about this decision and and about maybe a different way to structure the language that would allow

Speaker 549:07

the counties that really need the help to get what they need,

Speaker 549:10

but to recognize that the diversity of the state both in terms of population,

Speaker 549:14

and the threat of Covid

Speaker 549:15

can maybe made managing in a different way. Thank you very much, and appreciate the time that you guys have put to to get this meeting together.

Speaker 549:23

Thank you very much, sir. Next speaker, please.

Speaker 1049:28

Good afternoon, everybody. How are you?

Speaker 549:32

We are well. You. Go ahead, please.

Speaker 1049:34

Alright. So, my name is Tommy Harris. I'm a resident of Ko cross County.

Speaker 1049:39

I do not support this in its current verbiage

Speaker 1049:42

as an alternative. I would suggest,

Speaker 1049:45

do not allow any counties to close.

Speaker 1049:48

They're fishing. I do understand the

Speaker 1049:52

concerns of the Eastern Sierra County. So my suggestion would be to

Speaker 1049:56

limit fishing to only within your county line.

Speaker 1050:00

If you're a resident of Twenty County, you can only fish within Twelve County, etcetera, etcetera,

Speaker 1050:06

be enforce by an imp of water

Speaker 1050:10

complication of gear finds aside from the social distancing fine,

Speaker 1050:14

replication of your fishing license.

Speaker 1050:17

And I do understand that a lot of... Counties in California are divided buy water. So if it is a shared

Speaker 1050:24

water way on a county line

Speaker 1050:26

to, allow both counties to fish on that,

Speaker 1050:30

specific water way.

Speaker 1050:33

That's my two cents to my suggestion, to, help mitigate all this take for your time.

Speaker 550:39

Thank you very much, sir. Next speaker, please. Hi. Good afternoon. My name is Joe,

Speaker 550:43

and I'm in the fifty first district, which is the seventh fourth part of San Diego.

Speaker 550:48

Thank you for your time

Speaker 550:52

I just wanna say,

Speaker 550:55

two things.

Speaker 550:56

I think

Speaker 550:58

like, others have said, it's a little drastic.

Speaker 551:01

The way things are written.

Speaker 551:03

In which it seems to me where

Speaker 551:05

closures can be

Speaker 551:07

done quickly and anywhere, even outside of the three counties, which are I very empathetic towards.

Speaker 551:14

At the same time, I do know

Speaker 551:17

if you guys are gonna do what you gotta do, So rather than to try to

Speaker 551:22

convince you guys to do otherwise,

Speaker 551:24

I I asked that you guys were take into consideration. When you guys do open up these fisheries.

Speaker 551:31

Again,

Speaker 551:32

I know it won't be a big flood gate that just opens up and, hey, everybody get at it, but that he was take into consideration,

Speaker 551:39

Kayak Fisherman who are the solo list of solo.

Speaker 551:43

We,

Speaker 551:44

we fish on a regular, even when work together, we're not together.

Speaker 551:49

And also, I really like the left guys idea regarding

Speaker 551:53

finalizing

Speaker 551:54

those who disobey the orders,

Speaker 551:57

rather than finalizing the entire fishing community.

Speaker 552:02

And so please consider Kayak Fisherman as far as when you're opening these fisheries,

Speaker 552:07

we should be the last one pushed out and the first one

Speaker 552:11

let back in. Thank you, guys very much. You, sir. Appreciate it. Next speaker, please. Hello, and thank you to all the officials and attendance of this call. Can you hear me?

Speaker 552:20

Yes. We can. Go ahead, Ashley.

Speaker 552:22

My name is Aaron Wolf I'm a licensed nurse in California and Public health nurse. With the national Board certification and emergency department.

Speaker 552:29

I appreciate the concerns of the smaller communities regarding the fear of the influx,

Speaker 552:35

and that associated risk. I understand the infection risk and the potential for hospital capacity strain is that's why I field of focus.

Speaker 552:43

I oppose the pursuit of this additional regulation.

Speaker 552:47

The charge efficient wildlife is to protect efficient wildlife. The public health agencies protect public health through their orders.

Speaker 552:54

Current public health orders provide adequate authority to enforce the need to reduce the spread of Covid nineteen.

Speaker 553:00

These public health regulations automatically adjust for public health orders and the governor

Speaker 553:06

Christian Wildlife agents can support the public health needs with current practices of monitoring angle behavior

Speaker 553:13

and checking

Speaker 553:14

addresses associated with licenses.

Speaker 553:16

Our request is enforcement.

Speaker 553:20

For all of this,

Speaker 553:22

and limiting access to local residents based on the local public health orders for what it's best to reduce the risk to the communities

Speaker 553:30

and,

Speaker 553:31

more regulations will just further stress the in the, law enforcement resources

Speaker 553:36

and risk or you're through two years time is Been Thank you. Thank you. Thank you. Take, please. Yep. Oh, okay. Yeah. Yes. I'm at Angle. I've been coming to this year for forty one year.

Speaker 553:47

I support either

Speaker 553:49

where you deal with this. I'm also a second homeowner in Mammoth Lakes, you owns every

Speaker 553:54

residents. I rent to full time residents there. I come to the Sierra ten fifteen times

Speaker 554:02

a month

Speaker 554:03

or or put in those days.

Speaker 554:06

I have tons to friends... Everybody wants the opening day. I'm in favor of closing the whole thing to local residents or no or not. Is what are you gonna do with second homeowners.

Speaker 554:16

I don't agree with letting me finish

Speaker 554:19

county to county. It's just... It's not gonna work. People are gonna load up, you know, friends in their places and all that. So whichever way you go,

Speaker 554:28

hundred percent

Speaker 554:31

close it or a hundred percent open it.

Speaker 554:34

Thank you. Thank you, sir. Next speaker, please.

Speaker 854:37

Hi. This is Jeff. Can you hear me?

Speaker 554:40

Yes we can, Jeff. Go ahead.

Speaker 554:42

Perfect.

Speaker 554:44

I. I think you guys are overs step your boundaries and this in the scenario. Thirty pieces up put in place for you guys to go ahead and manage this for those counties that actually don't want these visitors. We have to stay at home or.

Speaker 554:56

That's already been said numerous times.

Speaker 554:59

I I do believe you guys are better served actually having a campaign

Speaker 555:02

they go out it's talk about social distancing and to talk about those counties that don't have access or show up. So those are are in my opinion the solutions talk to these counties in order to do so. Second thing is listening to these counties and their hypocrisy is is pretty sad. Talk I just heard someone say that Eastern Sierra is

Speaker 555:21

is the highest per capita infection rate. And yet every one of these people in the Eastern Sierra is actually advocating that only locals fish there.

Speaker 555:31

Anyone can't see the box seeing that. I don't I don't know what's wrong with you.

Speaker 555:35

Alright. Thank you very much.

Speaker 555:36

To my opinion.

Speaker 555:38

Alright. Appreciate it. Next speaker, please.

Speaker 555:47

Hi, doing. My name is Andrew Gibbons on a resident of Sandler Bernardino County, and I have been fishing with Eastern Sierra for thirty five years.

Speaker 555:55

I represent the urban outdoors in Youtube channel over five thousand

Speaker 556:00

subscribers.

Speaker 556:00

I just wanted to chime in on this topic. I appreciate all the politicians that have given their perspective. I think it's important to understand that most of the people on the... Politician side, our people that probably have never

Speaker 556:13

have never fished in their lives. So we're taking into account a lot of, first responders side with these opinions. But on the fishermen side, I think that we are greatly discounting

Speaker 556:25

that the fishermen are taking the brunt of this. We're we are, like, touching the blame of the spread here. And

Speaker 556:33

basically,

Speaker 556:35

no fisherman is going to go to the sierra unprepared. I think a lot of the... We've already made it clear that a lot of the

Speaker 556:42

support at their motel, all that stuff is already shut down. So Push are gonna go up there and pretty much have to bring what they gotta bring anyway. And everything else is kind of handled at a local level as far as

Speaker 556:56

you know, social distancing thing order.

Speaker 556:58

The county how...

Speaker 857:02

I'm sorry?

Speaker 557:03

Yeah. You're one minute up, can you wrap up, please?

Speaker 557:06

Oh.

Speaker 557:07

The the orders are also being mis mistreated by the governor is that there is no such thing as

Speaker 557:13

stay at home.

Speaker 557:15

I'm sorry, sir so your time... Your time is next caller, please?

Speaker 557:19

Okay.

Speaker 1157:24

Hello. Can you hear me?

Speaker 557:26

Can. Go ahead, please.

Speaker 1157:27

Great. Thank you, sir. Thank you for your time.

Speaker 1157:32

This is from the California

Speaker 1157:34

constitution. My name is Dan, Brennan. I'm an Avid fisherman and I fish my whole life in the state of California and all over the west.

Speaker 557:41

The people shall have the right

Speaker 1157:43

to fish upon and from the public lands of the state and the waters thereof of

Speaker 1157:49

Accepting upon land set aside for fish hatch trees, and no land owned by the state shall ever be sold or transferred without reserving in the people, the absolute right to fish there upon, and no loss shall ever be passed

Speaker 1158:03

making into crime for the people to enter upon the public lands within this state for the purpose of fishing, and any water containing fish that have been planted therein end by the state, provided that the legislature by the statute

Speaker 1158:17

provide for the season when the conditions under which the different species of fish may be taken.

Speaker 1158:23

It's pretty clear.

Speaker 1158:25

I was adopted in the eighteen hundreds by our state.

Speaker 1158:29

We have every right to be there. We're all adults

Speaker 1158:33

I think you can open the season.

Speaker 1158:35

There's no there's no problem

Speaker 1158:38

from someone from Orange County going to the Southern Sierra for day of fishing coming back. It's not a problem your time. Thank you. Thank you. Appreciate it. Next speaker, please.

Speaker 858:53

Good afternoon, commissioner.

Speaker 858:55

Thank you for everything.

Speaker 858:56

This is mike and Terry with official business. Again,

Speaker 858:59

much with that nurse practitioner said is what we agree on what we were gonna state we just pray and hope that you guys do not close this down

Speaker 859:08

in any any fashion for the fishing and the honey community. Thank you for your time.

Speaker 559:16

Thank you very much, sir. Next speaker, please. Still garcia.

Speaker 559:19

My, eight year Veteran.

Speaker 559:23

Just wanted to state that I have... Thank you. I oppose the commission with gripping any sport fishing,

Speaker 559:29

while I also oppose the,

Speaker 559:32

county restricting sport fishing or access to public or private waters.

Speaker 559:37

I believe that that is the

Speaker 559:40

at the full discretion of accountants,

Speaker 559:42

and I am troubled with the language that has being used

Speaker 559:45

on this call today as well as,

Speaker 559:49

not matching what's in the regulatory

Speaker 559:51

section eight point zero two,

Speaker 559:53

specifically that this is a

Speaker 559:55

quote unquote surgical

Speaker 559:57

designed

Speaker 559:59

procedure to, if only effect the three counties that have requested it, yet the language that's in section eight point zero two does not surgical or in any way,

Speaker 51:00:10

identify those three,

Speaker 51:00:13

accounted for the restriction it is a a blanket in restriction.

Speaker 51:00:18

Thank you.

Speaker 51:00:20

Thank you, sir. Next speaker, please.

Speaker 51:00:27

Yes Go ahead, please. My name is Christopher James. I'm calling from Daly City in Summit mateo County. I just wanted to point out that the changes

Speaker 51:00:35

focus purely on giving authority to the director of the Ftc in consultation with the president and the Commission to close fishing specific areas were needed.

Speaker 51:00:42

Quote from the draft

Speaker 51:00:44

statement.

Speaker 51:00:45

Commission finds as a direct can more properly respond to change circumstances and shipping guidance from public health organizations and the commission can as a body.

Speaker 51:00:53

However, any reduction in existing oversight, it's always problematic. And if the commission still were still to be consulted.

Speaker 51:01:00

The then there should be no need to remove the need for a quorum vote in the first place.

Speaker 51:01:04

Additionally, if there's only three counties requesting this, then changes regarding efficiency should be a low priority.

Speaker 51:01:10

Is my opinion that efficiency related changes being made because it may be envisioned by counties might request closures

Speaker 51:01:16

and this makes the whole resolution effectively more open ended than originally conveyed. If any change was required a much better compromise resolution would be to simply delay trial season to the same date that the promotion emergency resolution that end at and make no other changes.

Speaker 51:01:30

You

Speaker 51:01:33

Thank you very much. Next speaker, please. Hi. Can you hear me?

Speaker 51:01:36

Yes. We can. Go ahead, please.

Speaker 51:01:38

Hey.

Speaker 51:01:39

I'm gonna

Speaker 51:01:41

remain with. I'm from the

Speaker 51:01:43

from San Mateo County.

Speaker 51:01:45

And I just wanna,

Speaker 51:01:46

point some people that,

Speaker 51:01:49

the people that say that they can

Speaker 51:01:52

be responsible and travel to another accountant,

Speaker 51:01:56

not spread the virus,

Speaker 51:01:57

there's still a chance

Speaker 51:01:59

when you're driving to another county that you break down,

Speaker 51:02:03

or when you're fishing, you get hurt and you're gonna be pulling the resources from that county

Speaker 51:02:07

and possibly inspecting

Speaker 51:02:09

emergency responders,

Speaker 51:02:11

or, like, even if you're...

Speaker 51:02:14

If you need gas some house, unless you bring your own gas thing, you have to stop at a gas station and a gas station employee can be infected. So,

Speaker 51:02:22

it's... There's not a one hundred percent way to

Speaker 51:02:26

stop spread if you think you can travel to, like, Mono or San County from somewhere else. Thank you.

Speaker 51:02:32

Thank you, sir.

Speaker 51:02:34

Next speaker, please.

Speaker 51:02:38

This is Terry Simon to ta Hay County.

Speaker 81:02:41

I'd like to share with you, and thank you for your time. First of all,

Speaker 81:02:46

ta County,

Speaker 81:02:48

has no Covid

Speaker 81:02:51

patient currently.

Speaker 81:02:53

And I do respect the fact that their small communities don't want to be infected, but I also believe in the

Speaker 81:03:01

constitution, and therefore, I oppose the way the current draft is presented. Thank you for your time.

Speaker 61:03:10

Thank you. Next speaker, please. Hi. This is Danielle from the American Sport Fishing Association. Once I apparently dial

Speaker 61:03:17

Go ahead, please. I'm so sorry.

Speaker 61:03:21

Yeah. So I'll follow the rules and, just say that of the american Sport fishing Association would like to second to the comments made by a being client from the Congressional Sports foundation. And also, just note that we so appreciate how comm the The director has been and the commission as well. And

Speaker 61:03:39

whatever decision is made down the road in terms of fishing access we just very much encouraged

Speaker 61:03:46

open minded of communications to continue.

Speaker 51:03:50

Great. Thank you Very much. Thank you. Lauren, has anybody else

Speaker 51:03:53

come on since then? I don't see anyone else queued up at this time. Okay. I'm gonna give people just another minute or two to push pound to or to red dial in and press pound Too you wanna let see we get anybody else in the queue. Take a two minute break, and then we'll come back and if nobody's on, then we'll move on to his staff and and and commission.

Speaker 51:04:10

Hi. My name is Lewis Demi from San Diego County. Can you hear me?

Speaker 51:04:15

Yes. We can, sir. Go ahead, please.

Speaker 51:04:18

Hi. And you guys are mandated to protect our rights, the Hunting and fish so I oppose any changes

Speaker 51:04:24

if anything, you guys should be actually assisting us two fishing locations and protecting us from anyone who opposes us.

Speaker 51:04:32

Please do not change anything, leave it up to local authorities.

Speaker 51:04:36

And if anything, you guys be getting in a standoff with those local stories

Speaker 51:04:41

convey to where we hunt and fish. Thank you.

Speaker 51:04:45

Thank you, sir. Next speaker, please.

Speaker 51:04:53

My name is Chris Mona from San diego County. Wanna take commission for a allowing speak, I wanna also voice my opinion that I oppose any changes made to fishing season or postpone fulfillment or delay. Thank you again for your time.

Speaker 51:05:06

Thank you. Appreciate it.

Speaker 51:05:08

Next speaker.

Speaker 51:05:12

Hi. I'd like to remain named San diego County. I think for your time. Just like to reiterate... Reiterate article on section twenty five, which I know y'all all are very I'm aware of and informed on. Also,

Speaker 51:05:24

we use fishing as a way to stress down here, and a lot of the local lakes have made

Speaker 51:05:29

the access unavailable. I just like you guys to support us, also support and put emphasis on the City of Cv diego. To open up the lakes down here because if we're water fishing, there's nowhere for us to water fish in San Diego County. And at this time, we're paying for our fishing permits and our hunting permits, which the the national forest service is also closing down area down in San Diego County. So at this time, we're unable to trip hunt or batches,

Speaker 51:05:55

and we're paying for the permits. And if you guys are not gonna open them, we're gonna meet a refund for our hunting and fishing license.

Speaker 51:06:01

Thank you.

Speaker 51:06:04

Thank you, sir. Next speaker, please.

Speaker 51:06:06

So

Speaker 51:06:07

Sounds like somebody has their,

Speaker 51:06:09

mike open if your member staff or department, please mute.

Speaker 51:06:13

Otherwise, next speaker, please.

Speaker 51:06:17

And if you're speaker, you need to un unmute.

Speaker 51:06:22

Yes.

Speaker 51:06:23

My name is Doug Brown.

Speaker 51:06:25

Can you hear me?

Speaker 51:06:26

Yes. Again can. Go ahead, please. Okay. I... I'm... My name is Doug Brown. I'm a business owner in mobile counties.

Speaker 51:06:33

And if you're gonna... Have a delay on the fishing opener in the eastern here, I would

Speaker 51:06:39

recommend that you don't do it

Speaker 51:06:41

any later than May thirty first. That's all I wanted to say. Thank you.

Speaker 51:06:46

Thank you, sir. Next speaker, please.

Speaker 81:06:55

Yes. Thank you. This is

Speaker 81:06:57

Dan Wolf.

Speaker 51:06:58

Can you hear me? Yes. Yes. Go ahead, please.

Speaker 81:07:01

Yeah.

Speaker 81:07:03

Thank mister President. I'm speaking in support of the emergency action.

Speaker 81:07:07

I want to talk first to the

Speaker 81:07:11

proposed opt out of the auto conform feature.

Speaker 81:07:15

For marine fisheries.

Speaker 81:07:17

I understand Hope that this was only included for contingency purposes.

Speaker 81:07:21

And...

Speaker 81:07:22

But but that opt out, I'm in, the auto conform is an important part of our marine fisheries.

Speaker 81:07:28

And I do wonder if it needs to be retained as part of the emergency action

Speaker 81:07:32

and asked that you consider removing that element from the proposed action.

Speaker 81:07:37

Also wanna note that recreational fishing, there's an important part of a helium process.

Speaker 81:07:42

And, initially, I had some fear that it might be taken away from us.

Speaker 81:07:45

I'm pleased to see that neither the department nor the commission intends to come forth with Max closures.

Speaker 81:07:51

I'm gonna take you on your word for that, and this will be a good opportunity to build some positive

Speaker 81:07:56

relationships.

Speaker 81:07:57

Within the recreational community. So long as those quarters are indeed narrowly constrained to request from local agencies and temporary duration. Thank you.

Speaker 51:08:08

Thank you, sir. Next speaker, please.

Speaker 51:08:16

Yes. Go ahead. Can you hear me.

Speaker 51:08:18

Yes. We can. Yeah. Just wanna make a call at. Yeah. My name is Jeremy W out of City, California.

Speaker 51:08:23

Just

Speaker 51:08:24

let the boat off boat dock was full.

Speaker 51:08:27

He's elbow boat lost probably forty trucks and trailers,

Speaker 51:08:30

and nobody made contact with any other person besides he you came with.

Speaker 51:08:35

And I want that known to the state that when you go and you're with the group you came with, whether it be boat or bank?

Speaker 51:08:43

That's it.

Speaker 51:08:44

Great. Thank you very much. Next speaker, please. Thank you.

Speaker 81:08:48

And

Speaker 81:08:50

Hi. My name is Tom Pulp. I'm from In your county,

Speaker 51:08:54

and I feel that the commission's responsibility is to manage the and wildlife, not control with populations of people.

Speaker 51:09:02

Our local jurisdiction, government officials have already

Speaker 51:09:07

started that, and that is their responsibility.

Speaker 51:09:10

They've closed campground, rental properties

Speaker 51:09:13

made it difficult for

Speaker 51:09:15

anybody that's gonna travel from outside to to come here and say,

Speaker 51:09:20

and I feel that that's done well already. The early opener

Speaker 51:09:25

opened in March in County, And as far as I know, there's been no issues

Speaker 51:09:32

from out out of area people

Speaker 51:09:35

that had brought to C pennsylvania to to this area.

Speaker 51:09:41

You know, will all the rest of the areas that have already opened remain open.

Speaker 51:09:46

I believe that the department of Fish and Wildlife has already made a statement that the fish docking

Speaker 51:09:51

will continue where they can do a one person fish stocking, but where they're stocking all the small themes stuff, where it takes two people that they will not be doing it. And how will

Speaker 51:10:02

the rest of the non uninformed people know about

Speaker 51:10:06

the regulations that you are considering doing. I would be opposed for to

Speaker 81:10:12

Thank you.

Speaker 51:10:13

Thank you. Next speaker, please?

Speaker 81:10:20

Hi there. This is Kevin from Sacramento County.

Speaker 81:10:24

I can. Just wanna

Speaker 81:10:26

raise my opinion that I oppose the closure of our fisheries

Speaker 81:10:31

and

Speaker 81:10:32

reiterate the need for a centralized

Speaker 81:10:35

location,

Speaker 81:10:37

via website,

Speaker 81:10:38

that displays what bodies of water are currently closed. There's a lot of confusion of what's open and what's not. And,

Speaker 81:10:47

some sort of website that's updated showing what's closed

Speaker 81:10:51

that remains open would be extremely helpful. Thank you.

Speaker 51:10:55

Thank you, sir. Any other speakers, Lauren.

Speaker 61:10:59

That was the last speaker.

Speaker 51:11:01

Okay.

Speaker 51:11:02

I'm gonna close public comment then. We've

Speaker 51:11:05

given everybody a chance, I hope that people were able to resolve the technical problems we've gotten a full,

Speaker 51:11:10

range of comments, and I wanna thank everybody for that, certainly pleased that this has worked better than that than last week on our trial run and that, I wanna turn the mic over to director Buy to answer and address some of the questions that we're at.

Speaker 51:11:22

Address public company.

Speaker 51:11:24

Yes. So

Speaker 51:11:25

I wanna start

Speaker 51:11:28

and again,

Speaker 51:11:29

someone...

Speaker 51:11:30

Everybody take a moment, just check the phones

Speaker 51:11:33

It's here on the staff side, and it mute

Speaker 51:11:37

for commissioner side.

Speaker 51:11:39

And and I go that, Lauren. Can you make sure you mute mute all for all the public then that'll... And maybe there's somebody on the

Speaker 51:11:46

that.

Speaker 51:11:50

Okay. So the very first thing I wanna say, this is Chuck on again is a deep.

Speaker 51:11:57

Thank you full of appreciation for everyone.

Speaker 51:12:01

Who's dialed in today. I think we might have hit close to four hundred participants.

Speaker 51:12:07

This proves it's possible

Speaker 51:12:09

to

Speaker 51:12:10

do our public business.

Speaker 51:12:13

Under current circumstances

Speaker 51:12:15

in a way that's respectful of each other,

Speaker 51:12:18

gives us a chance to share and understand where we're all coming from independently,

Speaker 51:12:24

and

Speaker 51:12:26

thank you to each of the comment or elected official tribal,

Speaker 51:12:31

fishing leadership and individual citizens.

Speaker 51:12:35

Whether you fall in the agree, disagree,

Speaker 51:12:38

don't really know mixed feelings,

Speaker 51:12:41

each person

Speaker 51:12:43

really showed

Speaker 51:12:44

what it's like for us is Californian have a conversation on something we all care about. So a huge bank.

Speaker 51:12:52

In no particular order

Speaker 51:12:54

trying to think about some of the questions that I heard.

Speaker 51:13:00

Let me reiterate just out in the ocean.

Speaker 51:13:04

Yes, there appears to be a patchwork of approaches that is happening in coastal counties

Speaker 51:13:10

but things around peers, marina, harbors

Speaker 51:13:14

are not the commission nor the department

Speaker 51:13:17

jurisdiction.

Speaker 51:13:19

In fact, in the ocean, the department has worked really hard

Speaker 51:13:24

with the recreational fishing industry

Speaker 51:13:26

and commercial and recreational fishermen and women

Speaker 51:13:30

to get ground opened as an example

Speaker 51:13:34

to delay slightly the original part of the salmon season, but moves the thirty days to the back of the season.

Speaker 51:13:41

And in a matter of days, we think we're gonna have additional

Speaker 51:13:46

clarity for ocean, fishermen and women

Speaker 51:13:49

about

Speaker 51:13:50

keeping your recreational opportunity

Speaker 51:13:53

particularly for salmon in the ocean?

Speaker 51:13:57

Second kind of theme that emerged,

Speaker 51:13:59

how do we reopen?

Speaker 51:14:02

Well,

Speaker 51:14:03

I believe as director, we would reopen

Speaker 51:14:07

like potentially if we were granted this disability, we would delay.

Speaker 51:14:11

We would do it as promptly

Speaker 51:14:14

as possible,

Speaker 51:14:16

engaged with the local governments at the level of health

Speaker 51:14:21

law enforcement

Speaker 51:14:23

elected

Speaker 51:14:24

in tribal government,

Speaker 51:14:26

and we would try to move everything

Speaker 51:14:28

that might have been delayed

Speaker 51:14:30

to reopen

Speaker 51:14:31

promptly.

Speaker 51:14:34

Also, I think,

Speaker 51:14:36

if you look at the actual proposed draft regulatory language,

Speaker 51:14:41

anything

Speaker 51:14:43

that might be delayed

Speaker 51:14:45

under section eight point o two b

Speaker 51:14:49

would necessarily be opened

Speaker 51:14:51

by the time you get to section g

Speaker 51:14:54

and all of the

Speaker 51:14:56

regulation expiring

Speaker 51:14:58

on May thirty first,

Speaker 51:15:00

So either,

Speaker 51:15:01

I think you would see reopening because of the expiration

Speaker 51:15:06

or the department and consultation with the president local government and tribes

Speaker 51:15:12

would reopen before then,

Speaker 51:15:14

or to avoid confusion, the department could affirm

Speaker 51:15:17

not only is the emergency

Speaker 51:15:19

regulation expiring,

Speaker 51:15:21

all of these waters are now open.

Speaker 51:15:24

As to another question,

Speaker 51:15:25

how will we know

Speaker 51:15:27

I would encourage folks to remember the actual proposed regulatory language. I think it's Section e

Speaker 51:15:35

directs the department to maintain a list of affected waters and restrictions

Speaker 51:15:39

we would be required to update that list daily by seven Pm.

Speaker 51:15:45

And also, there's a number to call for information. I'll tell everyone that number right now. It's nine one six

Speaker 51:15:52

four four five.

Speaker 51:15:54

Seven six zero zero, and those two fish official lot,

Speaker 51:15:58

and it is true that some of your elected and non elected officials do fish on one of them.

Speaker 51:16:04

Know that those mechanisms already exist

Speaker 51:16:07

to figure out what is open and not open.

Speaker 51:16:10

So that's something that came up.

Speaker 51:16:15

As to

Speaker 51:16:17

input

Speaker 51:16:17

well placed by supervisors from Del,

Speaker 51:16:20

Trinity and Humble,

Speaker 51:16:23

each of whom I know.

Speaker 51:16:25

I hear you.

Speaker 51:16:27

I understand your suggestion of the word consultation.

Speaker 51:16:31

I will give you my personal commitment. The way I would approach this as director

Speaker 51:16:36

is to be in

Speaker 51:16:37

consultation.

Speaker 51:16:38

With

Speaker 51:16:40

county

Speaker 51:16:41

as they may come to the department and the commission.

Speaker 51:16:45

I would be interested in consultation with the public health officer,

Speaker 51:16:49

the sheriff

Speaker 51:16:51

and the Board of supervisors.

Speaker 51:16:53

Before the department

Speaker 51:16:54

and I as director would form any opinion on what to do.

Speaker 51:17:03

Same personal commitment as director to each tribal government

Speaker 51:17:07

that may elect to engage with the department on this.

Speaker 51:17:10

The door would be open. Our travel advisor Nathan Bog and I would want direct

Speaker 51:17:16

communication with the right part of a tribal government. If they were still inclined to

Speaker 51:17:21

come to us because of this emergency

Speaker 51:17:23

regulation.

Speaker 51:17:28

I understand Bart Hall suggestion to consider adding days at the end of the season,

Speaker 51:17:33

if we delayed at the beginning.

Speaker 51:17:35

I think that's a legitimate variable, the department and the commission and,

Speaker 51:17:40

our stakeholders would want to engage on.

Speaker 51:17:43

Because you are right, the department and the commission are committed to increasing

Speaker 51:17:48

not decreasing opportunity.

Speaker 51:17:50

And but for this pandemic, we wouldn't be talking about this situation.

Speaker 51:17:56

To remind folks,

Speaker 51:17:59

couple poke folks asked about how can we trust

Speaker 51:18:03

unity and what if there are discrepancies

Speaker 51:18:06

in ways, local government wants to treat it and

Speaker 51:18:11

how the state government may approach it through the commission in the department?

Speaker 51:18:16

This emergency

Speaker 51:18:18

regulation self expires in forty six days.

Speaker 51:18:23

I would also, if given this ability as director,

Speaker 51:18:27

the required

Speaker 51:18:29

to come to the commission's meeting

Speaker 51:18:31

in, like, a matter of three weeks early May mid May

Speaker 51:18:36

and do a full transparent

Speaker 51:18:38

reporting

Speaker 51:18:38

of what has or has not happened

Speaker 51:18:41

relative to this emergency

Speaker 51:18:43

regulation.

Speaker 51:18:45

Why not just say three counties?

Speaker 51:18:48

Look, when we started to realize this could be an issue, we were still also trying to get our arms around who might be interest?

Speaker 51:18:58

The regulation reflects the fact that the criteria

Speaker 51:19:01

prohibits the department from taking steps

Speaker 51:19:04

without

Speaker 51:19:05

consultation,

Speaker 51:19:06

my words,

Speaker 51:19:08

consultation, my commitment director,

Speaker 51:19:10

consultation with local government,

Speaker 51:19:12

and in consultation with the president.

Speaker 51:19:16

I don't think they've granted disability, it's why it's for the department for runoff and use

Speaker 51:19:22

without

Speaker 51:19:23

constant

Speaker 51:19:25

regular

Speaker 51:19:26

communication with likely affected stakeholders.

Speaker 51:19:29

We realize the importance of recreational efficiency.

Speaker 51:19:32

Here's an easy one, no.

Speaker 51:19:35

We're not exercising marshall law,

Speaker 51:19:41

just running through the questions I've been asked.

Speaker 51:19:46

I'm aware of article one, section twenty five. I've read it.

Speaker 51:19:50

I've memorized it.

Speaker 51:19:52

Well, I don't practice anymore. I am a

Speaker 51:19:55

an attorney by background.

Speaker 51:19:58

I will remind folks that the last provision of that article

Speaker 51:20:03

says

Speaker 51:20:05

except for

Speaker 51:20:07

the ability to restrict seasons in use.

Speaker 51:20:10

That's been tested in court regularly.

Speaker 51:20:13

I think what the commission would be doing here if it were to approve the emergency

Speaker 51:20:18

regulation.

Speaker 51:20:19

Is restricting use around the season.

Speaker 51:20:24

The department could have come to the commission with a proposal like the state of Washington.

Speaker 51:20:31

We did.

Speaker 51:20:33

We tried to find something careful deliberate and thoughtful.

Speaker 51:20:37

We've been given this

Speaker 51:20:39

delegation only once before during the drought.

Speaker 51:20:42

We've only used it once.

Speaker 51:20:46

In the next forty six days, I realized we need to prove

Speaker 51:20:52

It's worth trusting us, and that would be my focus as director.

Speaker 51:20:57

So with that, let me stop there.

Speaker 51:20:59

Great. Thank you.

Speaker 51:21:00

So I wanna I wanna say a few words and that, well I do so I wanna ask my fellow commissioners if they have questions for comments they wanna make before we look at a motion of possible motion to I use the rate hand, so I'll come to you in order in just a minute.

Speaker 51:21:14

I wanna start by thanking director Bon for, his efforts in the last week to,

Speaker 51:21:21

last three weeks really to to look at fashion this this measure,

Speaker 51:21:25

proposed measure,

Speaker 51:21:26

or working with us over last week and direct an department to work with us to find a way to make this meeting work, and and I hope most people feel it worked pretty well.

Speaker 51:21:34

Perfect is never achievable, but I think it was

Speaker 51:21:37

quite amazing how well it went and and how we're able to take public comment in a flowing fashion

Speaker 51:21:43

after, you know, a false start last week. I wanna thank the department staff for all their work on this. I wanna thank Jordan

Speaker 51:21:51

Sub for her great work on on

Speaker 51:21:53

communicating what had happened and what we really were doing because I think that made a huge difference in terms of, people's understanding today. The staff of the commission has been unbelievable. We have a very tiny staff who have a ton on their plate under normal circumstances,

Speaker 51:22:07

and this, both the technological challenges is making this work,

Speaker 51:22:10

and the actual substance of it added an enormous amount of work, I particularly wanna to thank are incredible executive director who has been working seven days a week,

Speaker 51:22:18

longer hours than I that I can imagine to make this happen and I wanna express the gratitude of the commission and and for the state

Speaker 51:22:25

for Mill or leadership and teamwork. And I wanna thank the public who participate participated today. Again, as Director Bottom said people were respectful, they had thoughtful comments,

Speaker 51:22:34

that we're helpful and productive, and, I know we're gonna take them in consideration as we now,

Speaker 51:22:40

I'll move on to commission discussion.

Speaker 51:22:43

Let... Man, and I like to ask

Speaker 61:22:45

director. I mean, exact director. She make a comment to and I see that that one commissioner has a like gas Go ahead and. I just like to build on your statement about the public comment, and we do recognize that there were, you know, some technical glitches today, and we're able to work around them mostly.

Speaker 61:22:58

We do are aware of my handful of people who were not able to get through

Speaker 61:23:03

but we also

Speaker 61:23:05

recognize that for some of those comments,

Speaker 61:23:08

we we've had conversations directly with them and have a a relatively good sense,

Speaker 61:23:12

and we're trying to convey that to our,

Speaker 61:23:15

commissioners.

Speaker 61:23:16

But also wanted to highlight that we did have a tribal

Speaker 61:23:20

representative who was attempting to connect earlier this morning when we were having some of our technical issues and,

Speaker 61:23:27

wanted to highlight that the satellite knee eighth Nation would like to engage in a government government

Speaker 61:23:31

compensation on this. That's it.

Speaker 51:23:33

Sure we, we will certainly do that.

Speaker 51:23:36

Commissioner Maria, see if you have your hand rates, please. Chime in.

Speaker 61:23:40

Yeah. And and I don't have a question as message I just wanted to make a few comments based on everything we heard if that's okay. That's of course. And then after you all call on,

Speaker 51:23:49

Commissioner Officer Conversation.

Speaker 61:23:50

Great. So I wanna echo all the banks to tribes elected officials numbers of the public for your engagement and

Speaker 61:23:57

absolutely express my gratitude to,

Speaker 61:24:00

to all of our fifty and commission and department professional by staff

Speaker 61:24:04

for the thoughtful and thorough

Speaker 61:24:06

economic and fiscal impact statements,

Speaker 61:24:09

in particular, that analyze these sort of twenty five fifty, hundred percent

Speaker 61:24:14

fishing or restriction and scenarios for economic impact. Those impacts are significant, of course. And I I pre appreciate this being able to see the effort that's gone into aggregating that information, creating the tables and graphs found within the economic and fiscal statement. It's a a real testament

Speaker 61:24:33

to the deli declaration and thought that has gone into this decision making,

Speaker 61:24:37

and it inspires a lot of confidence in the kind of detail oriented approach that I think we can expect. As we tackle this moving forward.

Speaker 61:24:45

On a personal note, I just... I... You know, I work full time outside of this position with the commission now remotely

Speaker 61:24:52

at home with my two kids, we're six and seven while I also now home cool them. So I really do understand firsthand,

Speaker 61:25:01

the important mental health benefits of getting

Speaker 61:25:04

away being outside, commuting with nature.

Speaker 61:25:09

Last week, my kids and I

Speaker 61:25:11

we're lucky enough to to to purchase six live Ab from our local Southern California Ab farmer,

Speaker 61:25:17

not only in an effort to support local businesses, but also to sort of connect with Nate to do something together as a family.

Speaker 61:25:24

And I Again, I just... I really understand wanting to be able to get out on the water. I want to be able to go to the beach, hike on trails,

Speaker 61:25:32

but the governor's order is clear. And right now, we have to balance those wellness benefits with the serious long term costs.

Speaker 61:25:39

That it could have for our state's communities.

Speaker 61:25:42

And I trust director or Bon to do that. And it's not because I don't trust us

Speaker 61:25:48

as the sufficient game commission,

Speaker 61:25:50

or because I don't trust local government to manage these

Speaker 61:25:53

themselves.

Speaker 61:25:55

But we heard at the top of the meeting that different counties

Speaker 61:25:59

have different requests, different concerns, different needs. You know, Those of Mona and Inn,

Speaker 61:26:05

Trinity Del, El dorado. They're all... They all have different priorities in balancing short term economic gains with long term public health.

Speaker 61:26:14

And I really see that director bottoms can act as a clearing house for those wolf of requests, while acting as point person with president Sk

Speaker 61:26:23

in considering and taking action in a way that is

Speaker 61:26:26

both surgical

Speaker 61:26:28

and keep the comprehensive

Speaker 61:26:30

statewide landscape in mind.

Speaker 61:26:33

I trust that director Bon can balance equity and access

Speaker 61:26:37

while also keeping mental health in mind for all

Speaker 61:26:40

and can think about statewide impacts

Speaker 61:26:43

and work to avoid inadvertently concentrating fishing effort in the remaining open areas, which I also heard from from some comment answers,

Speaker 61:26:52

So I I think the director bon in consultation with Parsons Clark can act n in an emergency

Speaker 61:26:57

situation,

Speaker 61:26:59

not only to temporarily

Speaker 61:27:01

suspend, but also to quickly reopen fishing in a timely way.

Speaker 61:27:05

If public health, if and when public health recommendations and governor News guidance

Speaker 61:27:10

allow it. We are not talking about a blanket closure today, there is expressed accountability to us at a game Commission

Speaker 61:27:19

that is built into this emergency

Speaker 61:27:21

regulation, you know, it includes reporting back to the commission on any decision made,

Speaker 61:27:26

and it's not open ended. It expires May thirty first. So for these reasons, I just wanted to, to lay out these reasons. So but I... I I will be supporting this temporary emergency

Speaker 61:27:37

regulation.

Speaker 51:27:38

Thank you very much, by vice President Murray. Really appreciate your thoughtful comments and appreciate that.

Speaker 51:27:44

Commissioner your hostile commerce, please.

Speaker 61:27:47

Yes. Thank you, President Sal. I also want to extend huge thank you and

Speaker 61:27:54

appreciation to Melissa and efficient Game commission staff as well as director Bottoms.

Speaker 61:28:00

And his entire staff. I think

Speaker 61:28:03

that you have really done a great job today in Laying out,

Speaker 61:28:07

director bottom and president Sk. That the Phishing Game commissioned together with the department

Speaker 61:28:14

we really do understand.

Speaker 61:28:17

And

Speaker 61:28:18

I believe that we have built trust, I believe we will

Speaker 61:28:22

continue to build trust

Speaker 61:28:24

with the fishing community. And I think today's call really exe emphasize that And I do believe it should be a case by case basis

Speaker 61:28:33

with local control,

Speaker 61:28:36

and and I also

Speaker 61:28:38

know that president

Speaker 61:28:40

Will reach out to us

Speaker 61:28:42

individual commissioners.

Speaker 61:28:44

On those case by case basis,

Speaker 61:28:46

if he feels that more input is needed, and we have the ability to also give our input to

Speaker 61:28:55

president Clark.

Speaker 61:28:56

And

Speaker 61:28:57

I really think that everything that we have done over the last several years is working towards building trust with the stakeholders

Speaker 61:29:06

with the drives and with the,

Speaker 61:29:10

leaders.

Speaker 61:29:11

In the phishing gain

Speaker 61:29:13

commission. Thank you.

Speaker 51:29:15

Thank you. Commissioner Officer Car. Next commissioner Silva, please.

Speaker 51:29:21

Yes. Thank you. Mister President.

Speaker 51:29:23

I also just wanna also just

Speaker 51:29:26

so they're really support thing that the

Speaker 51:29:29

commissioner Murray mentioned,

Speaker 51:29:31

just about the great that department it to,

Speaker 51:29:34

you know, I have a a very good legal and technical

Speaker 51:29:38

basis for this action.

Speaker 51:29:41

I also wanted to say that that they knowledge do it much better do they appreciate that. You know, we had

Speaker 51:29:46

commissioner Mir and I had a heck of a time with our

Speaker 51:29:50

our

Speaker 51:29:53

permission meeting, you know, two weeks ago, our

Speaker 51:29:55

So this was much much better one big improvement like kudos to everybody to put it together.

Speaker 51:30:01

And, finally, I wanted to a couple of things. One is you, obviously, this is based on trust. And, you know, I think right now that you farm my.

Speaker 51:30:07

And the commission are working really well together and, you know, it's... One of the commissioners really

Speaker 51:30:12

support,

Speaker 51:30:14

you know, the the efforts of the departments and work with our president to to to move as quickly as it's possible to

Speaker 51:30:21

work for the counties as needed. So I, you know, that's, I think that's an indication of trust

Speaker 51:30:26

level that we have right now the can department of the commission.

Speaker 51:30:29

And just we'll add on that side and it's obviously, I think if the department work with the governor's office follow ups. It seems like Public calgary is about Would very important give some of the comments. There seems to be on confusion

Speaker 51:30:42

about what the department commission can and can do.

Speaker 51:30:45

So Just, you're, encouraged

Speaker 51:30:48

the department work that again there's office, And how you get better get the board out.

Speaker 81:30:54

Thank you.

Speaker 51:30:55

Thank you, Commissioner. Silva, we believe the commissioner burns have to leave the meeting, I'm just gonna see if he hears us And if he, I'm gonna give him a second to type in if you'd like to make a comment.

Speaker 51:31:05

Oh, I'm still with you, Eric. Okay. Great. Commissioner burns. Do you have any comments or questions?

Speaker 51:31:10

Yeah. I'll be brief. I just would like to really send out my appreciation to direct to bottom and your cell president's scar,

Speaker 51:31:18

even when we first went through this process earlier this month, it was hard for people to put their arms around it and truly understand what it meant. I believe that,

Speaker 51:31:28

today, it was laid out extremely well.

Speaker 51:31:30

Very easy to understand.

Speaker 51:31:33

I think that there was a lot of positive

Speaker 51:31:35

feedback, both Pro and Con, it it truly to me reflected that people

Speaker 51:31:40

got it and understand.

Speaker 51:31:43

In necessity for it whether they agree or not. And I'd also like to say both the department staff, and of course, our commissioner or staff for a job well done pulling this off today. Thank you.

Speaker 51:31:54

Great. Great. Thank you for commissioner Burns. I didn't hear from anybody that they wanna modify the resolution in any way, and unless somebody doesn't speak up now. I'd ask that somebody make a motion. It's on page

Speaker 51:32:05

three of the sap report for item too.

Speaker 51:32:18

The commissioner commission you'd like to make a motion? I'll make the motion.

Speaker 61:32:21

That the the commission declares its intent.

Speaker 61:32:26

To deviate from the automatic conform process

Speaker 61:32:30

identified in section one point nine five

Speaker 61:32:32

title fourteen

Speaker 61:32:34

Cc,

Speaker 61:32:35

three, am I on the right motion.

Speaker 61:32:39

I'm sorry. Yet yet yes you are. Thank you. Okay. Regarding Ocean Sam and Pacific Cal sport efficient regulations and finds as follows

Speaker 61:32:49

Speaker 61:32:57

preservation of the public peace health and safety

or general welfare

Speaker 61:33:02

based on the record, the proposed action is exempt from the California Environmental Quality act as an action necessary to prevent or mitigate an emergency as specified in section two one zero eight zero p b, p four of the public resources code.

Speaker 61:33:21

Pursuant to section one one three four six point one of the California government code and emergency

Speaker 61:33:28

situation exists.

Speaker 61:33:30

The proposed regulation is necessary to address the emergency,

Speaker 61:33:34

the emergency

Speaker 61:33:36

situation clearly poses

Speaker 61:33:38

such an immediate serious harm that delaying action to allow further notice in public comments after this meeting would be inconsistent with the public interest.

Speaker 61:33:49

And that immediate action is reasonably

Speaker 61:33:51

expected to prevent or significantly

Speaker 61:33:54

alleviate that serious harm.

Speaker 61:33:57

Therefore, the commission adopt the emergency

Speaker 61:34:00

regulation to add section eight point zero two.
